18~19세기 한성부(漢城府)의 사법 행정과 역할 (Jusicial Administration and Role of Hanseongbu(漢城府) in 18th~19th Century)

초록

본 논문은 18~19세기 한성부의 사법행정 및 법사로서 한성부의 역할에 대해서 살펴본 것이다. 한성부의 조직구성은 18세기 이후 변함이 없으나 19세기말 형조에서 차정된 검률을 추가적으로 배치하여 사송업무에 있어 조율의 정확성을 꾀했다. 하지만 사송의 적체를 방지하기 위해 실시한 한성부 낭청의 구임제나 관원의 고과(考課)와 관련된 결등공사의 입계 및 결송도수의 이첩 등이 폐지되고 관원의 해이해진 근무 상황에 대한 국가의 관리강화가 나타나고 있어 19세기 한성부의 법사 운영이 원활이 이루어지지 못하고 있음을 알 수 있다.
한성부의 사법 업무 중 가장 핵심은 입안 발급 및 소송의 판결이다. 한성부의 경우 6방의 방장들이 맡은 고유 임무가 있으나 입안발급 및 산송관련 상언에 대한 회계 처리 등 주요 사법업무는 낭청 전원이 담당하였다. 사송관사로서 한성부는 지방민에게는 상급관사의 역할을, 서울 방민에게는 일반 지역법사의 기능을 수행하였다. 한성부는 전택 소송만을 전담하는 관사에서 18세기이후 전택, 노비, 산송에 관한 전국적인 재판권을 행사하며 중앙법사로서의 역할을 수행하였다. 경외사송을 함께 담당한 형조와는 정2품아문으로 동일하며, 사송에 있어서 오늘날의 심급과 같은 법사 간 위계는 발견되지 않았다. 그런 의미에서 18세기 이후 한성부 사송직무의 확장은 법사로서의 한성부의 지위를 더욱 높이는 결과를 가져왔다.
한편, 한성부는 오부와 함께 서울지역 사송을 총괄하는 지역법사의 역할도 하였다. 오부의 경우 한성부와 달리 소송에 제한을 두었기 때문에 법사로 인식되지는 못하였다. 그러나 18세기 후반 정부가 오부를 종5품아문으로 올리면서 법사로서의 조직을 강화시켜 나가자 19세기이후 사법 업무에 대한 오부의 월권이 계속 문제시 되었다. 이처럼 전국의 사송을 주관하는 중앙법사이자 서울 내 분쟁을 판결하는 지역법사라는 한성부의 이중성은 다른 법사와 차별성을 가지는 것으로 한성부만의 특성이라 할 수 있다.

영어초록

This thesis reviews the role of Hanseongbu as the judicial administration and legal affairs of Hanseongbu during the 18th~19th century. The organizational structure of Hanseongbu has no change after the 18th century, but it additionally arranged the Geomryul(檢律) that was appointed by the Hyeongjo(刑曹) at the end of the 19th century for the accuracy in legal interpretation regarding the litigation affairs. However, the long-serving institution of Nangcheong(郎廳), reports of number of decisions in lawsuits and number of final adjudications, and others of Hanseongbu that were implemented in order to prevent any accumulation for litigation were repealed and the national control on lackadaisical work status of the government employees was shown that the judicial affairs of Hanseongbu during the 19th century was not flawlessly undertaken.
The critical part from the judicial affairs of Hanseongbu was the issuance of legislation and decisions of litigations. For Hanseongbu, main works of issuance of legislation and processing on litigation over tombs and land related pleading were undertaken by entire members of Nangcheong. Hanseongbu had the government office that was exclusively in charge of land and family residences to exercise the nationwide adjudicative rights on slaves and cemetery after the 18th century to carry out the role as the central legal affairs. The Hyeongjo that was in charge of the nationwide litigations did not show the hierarchical system between the legal affairs like the deliberations of today.
In this implication, the expansion of the litigation field in Hanseongbu after the 18th century brought the result of even more heightening effect of the status for Hanseongbu. In addition, Hanseongbu was compared to the local provincial governor(觀察使) with the Obu(五部) as local administrator(守令), but Hanseongbu did not have the jurisdiction over penal code compared to the local provincial governor that it had the greater role as the government offices on litigation. For the case of counties and prefectures the receipt of governor carried out the judicial affairs through certain level of hierarchical system, but for the case of Seoul, the judicial hierarchical system of Obu-Hanseongbu could be found in the local litigation matters, but it was not found between Hanseongbu and Hyeongjo.
