초록

유엔은 이주정책의 기본원칙으로서 ‘인권에 근거한 이주정책’ 또는 ‘공정하고 정의로운 이주정책’을 각 국가들에 요구하고 있다. 그러나 각 국가의 현실 영역에서 이러한 기본원칙을 관철하는 것은 쉬운 일이 아니다. 개별 국가에서 이주정책의 구체적 적용과정에서 나타나는 근본적인 문제는 바로 국가의 영토 주권과 보편적 인권 원칙 사이에 존재하는 구성적 딜레마에서 잘 드러난다. 이러한 주권과 인권 사이의 갈등은 구획된 영토에 기초한 국가중심주의적 국제질서와 지속적으로 발전하고 있는 보편적 국제인권규범 사이에 자리 잡고 있는 뿌리 깊은 대립의 문제이자 동시에 ‘시민권’과 ‘인권’ 사이에 존재하는 규범적 불일치의 문제이기도 하다. 이러한 근본적인 문제를 어떻게 해결할 것인가 하는 점이 이주인권을 둘러싼 논의에서 중요하다. 이 글은 벤하비브가 『타자의 권리』에서 고찰하고 있는 ‘정치적 성원권’을 통해 이주인권의 문제에 접근하고자 한다. 여기에서 다루고 있는 논점들은 다음과 같다. 성원권, 시민권, 국적 등의 개념의 상관관계는 무엇인가? 이주사회에서 정치적 시민권이 문제되는 이유는 무엇이며, 도대체 무엇이 핵심적인 문제를 이루는가? 이주사회에서의 정치적 성원권을 둘러싼 입장들은 무엇이 있는가? 세계시민적 또는 탈국가적 시민권 논의의 문제는 무엇이며, 벤하비브가 파악하고 있듯이 인권과 주권의 긴장관계로서 파악하는 논의의 한계점은 없는가? 주권적 결정을 강조하는 공동체주의적 입장은 어떠한 한계를 가지고 있으며, 다양한 스펙트럼을 가지고 있는 공동체주의에서 이러한 한계를 극복할 가능성은 없는가? 현재 이주노동자들을 둘러싸고 우리 사회에서 벌어지고 있는 문제는 이들 타자의 권리에 대한 승인의 결여 때문이라고 할 수 있다. 이러한 문제를 극복하기 위해서는 상호간의 수평적 존중과 상호간의 정체성의 승인을 통해 서로 공존할 수 있는 지혜를 모아야 한다.

영어초록

The United Nations request each nation to establish ‘migration policy based on human rights’ or ‘fair and just migration policy’ as its basic principle of migration policy. However, it is not easy to realize this principle under the actual situations of each nation. A fundamental problem arising from the real application of the migration policy of each nation is a constructive dilemma which exists between a territorial sovereignty of a nation and a universal principle of human rights. This conflict between sovereignty and human rights is a deep-rooted problem which remains between nation-oriented international order and a universal norm of human rights and, at the same time, a problem of normative discord which exists between ‘citizenship’ and ‘human rights’. How to solve this fundamental problem is important in the discussion concerning migrant human rights. This article approaches to the problems of migrant human rights through the concept of ‘political membership’ which is dealt with by Benhabib in her “The Rights of Others”. The issues in this article are as follows. What is the relationship among the concepts of memebership, citizenship and nationality? Why does politicial membership matter in a migration society and what, on earth, is the key issue with regard to it? Which positions are there concerning political membership in a migration society? What is the problem in the discussion concerning world-citizen or de-nationalized citizenship, and is there any limit in the discussion which understands this problem as a tension between sovereignty and human rights as Benhabib did? What kind of limit does a communitarian position which emphasizes a sovereign decision have, and isn’t there any possibility to overcome this limit in the communitarianism, which has a broad spectrum? The conflict regarding migrant workers in our society these days are the result of the lack of the acknowledgement of the rights of others. To overcome this conflict, it is needed to be wise enough to coexist through the horizontal respect of each other and the acknowledgement of the identity of each other.
