초록

This study examines the status of the military service law violates by athletes through court cases, and navigate to the improvement aims to defend the values of sportsmanship. This study is designed to analyze the leading research and legislation, and newspaper articles. The authenticity of the study was secured by the triangular method(transferability) and in-depth technology was adopted to increase the understanding of the analysis and interpretation of the results in the study. In addition, the study was audited to reassure its authenticity and dependence. The first case in the study was football players who deliberately dislocated their shoulder to waive the mandatory military service for surgery and recovery.
There were found baseball players who were exempted from the mandatary military service due to their excessive body weight. One case showed that a 171 cm - tall baseball player intentionally increased food consumption to increase the weight to about 106 kg and get exempted from military service. Even some athletes faked their mental health. A case was found that an active soccer player was penalized by Korean Military Manpower Administration by falsely claiming that he was suffering from schizophrenia and released from the mandatory army service. It is highly recommended to implement a stronger punishment for those who intentionally damage their body and other forms of fraudulent practices to avoid military service via appropriate law amendments. In addition, alternative military service should be expanded to the Olympic medalists and sports scientists to replace their mandatory national defense service.
