초록

1950년대는 신생국가 설립, 국가재건과 관련한 법제 청산과 생성을 위한 길항의 시대였고 법치주의를 근간으로 한 국가적 이념 구축을 위한 과도기였다. 법령을 통해 국가 기관을 구성하는 것은 매우 중요한 수순이었고 법의 안정성은 민주주의라는 국가이념을 정초하기 위한 필요조건이었다. 여성 교양과 문화를 선도했던 『여원』은 개인의 권리 보호를 위한 제도로서의 법에 대한 개념을 생성하며, 민법 제정에 대한 여론을 수렴, 친족상속편의 부계중심적 법률 조항과 전통 존중론의 젠더 불평등의 문제를 담론화했다. 『여원』은 창간 초기부터 여성들의 입장을 대변, 민법 제정에 대한 논의들을 독자들과 공유함으로써 법의식 형성을 주도했고, 여성의 법적 주체 형성을 가능하게 했다. 젠더적 법담론을 통해 여성독자들은 국가재건기 국민의 일원으로 동참할 수 있었다.
잡지는 법률상담 코너인 「법률상의」를 통해 독자와의 소통을 확대하면서 여성들이 일상에서 겪게 되는 혼인, 이혼, 재산상속, 호주제에 대한 법적 문제들을논의했다. 부계중심적 가족제도 내의 여성의 소외와 차별, 젠더 불평등의 법제도가 「법률상의」를 통해 폭로되고 전시됨으로써 가족법 개정에 대한 논의는 공감을 얻을 수 있었다. 익명으로 여성 삶의 내밀한 내용과 신변을 공개하는 행위는여성의 사회적 발언의 시작이었고, 여성의 문제를 스스로 공론화하는 계기가 되었다. 또한 법률 조항에 대한 여론조사 실시, 시위와 공청회의 참여, 국회청원 등의 활동에 관여함으로써 감정공동체를 형성하는 계기가 되었다. 1950년대 『여원』의 젠더적 법담론은 국가 재건기 국민화 과정의 일부로 논의됨으로써 여성의법적 주체의 형성과 법치주의에 의한 민주주의적 국가 정체성을 확립하는 계기가 되었고, 이를 통해 4.19를 예비하고 있었다고 할 수 있다.

영어초록

The 1950s was an era of antagonism for the establishment of a new state and the liquidation and creation of legislation related to national reconstruction, and it was a transitional period for the establishment of a national ideology based on the rule of law. Yeo-won, who led women’s culture and culture, created the concept of law as an institution for the protection of her rights, gathered public opinion on the enactment civil law, and discussed the issue of gender inequality in the paternal-centered legal provisions for the inheritance of relatives. Yeo-won led the formation of legal consciousness by representing the position of the women’s community and sharing discussions on the enactment of civil law with readers from the beginning of its foundation, and led to the growth of women as legal subjects. Through this legal discourse, female readers were able to form an identity as a post-war citizen and participate as a member of the actual national reconstruction period.
In particular, the magazine discussed legal issues about marriage, divorce, property inheritance, and the Australian system that women experience in their daily lives while expanding communication with readers through the legal consultation section “Legal Affairs”. Discussions on the revision of the family law were able to gain sympathy as the legal system of women’s alienation and discrimination, and gender inequality within the paternal-centered family system was exposed and exhibited through “Legal Affairs”. The act of anonymously disclosing intimate contents and personal information of women’s lives was the beginning of women’s social remarks, and it became an opportunity to form an emotional community by publicizing women’s issues. In the 1950s, “Yeowon” discussed gender legal discourse as part of the national reconstruction process, establishing a democratic national identity based on women’s legal subject and the rule of law.
