초록

대학 연극 공연은 학생들의 창의적 잠재력을 발휘하고, 예술적 성장을 도모하는 중요한 교육적 활동이다.
그러나 저작권법의 엄격한 적용은 대학 연극 공연의 실행을 어렵게 만들 수 있으며, 이는 학생들의 학습 기회를 제한할 수 있다. 따라서 저작권법의 공정이용 조항을 통해 교육적 목적을 위한 저작물 사용을 보다 원활하게 할 수 있는 방안을 모색하는 것은 매우 중요하다.
본 연구는 대학 연극 전공 학생들이 저작권 문제로 인한 어려움을 극복하고, 보다 자유롭게 창작 활동을 할수 있도록 돕는 데 기여할 것이다. 또한, 저작권자와 교육 기관 간의 협력 모델을 제안함으로써, 창작자의 권리를 보호하면서도 교육적 목적을 위한 저작물 사용을 장려할 수 있는 방안을 제시하고자 한다. 이 연구는 대학 연극 교육의 질을 높이고, 학생들이 예술적 역량을 충분히 발휘할 수 있는 환경을 조성하는 데 중요한 역할을 할 것이다.
이 연구는 대학 연극 공연에서의 발생하거나 발생할 수 있는 저작권 문제를 다룬다. 연구 대상은 미국과 한국의 저작권법이며, 두 나라의 법적 기준과 실제 적용 사례를 비교 분석하고자 한다. 이런 연구는 대학 연극전공 학생들이 실제로 저작물을 사용하면서 겪는 저작권 문제와 이를 공연화 하면서 발생하는 공연권 문제를해결하기 위한 방안을 모색하는 데 초점을 맞추고자 한다. 이를 위해 문헌 연구를 통해 저작권법의 기본 개념과 원칙을 이해하고, 공정이용의 범위를 파악한다. 또한, 미국과 한국의 저작권법 조항을 비교 분석하여 시사점을 도출하여 이를 바탕으로 대학 연극 공연의 교육적 활용을 위한 저작권 제도의 개선 방안을 모색하고자한다.

영어초록

The purpose of this study was to help students major in theatre or in theatre clubs overcome diffi culties posed by copyright issues and engage in creative activities more freely. This research plays an important role in enhancing the quality of university theater education and creating an environment where students can fully develop their artistic capabilities while examining the doctrine of fair use under copyright law.
College theater performances are a vital educational activity that fosters students' creative potential and artistic growth. However, the strict application of copyright law can hinder the execution of these performances, limiting students' learning opportunities. Therefore, exploring ways to facilitate the use of copyrighted materials for educational purposes through the fair use provisions of copyright law is crucial.
The study addresses copyright issues that may arise in university theater performances. It focuses on the fair use doctrine under the copyright laws of the United States and South Korea, comparing and analyzing the criteria for fair use in both countries. The research aims to identify solutions to the copyright challenges faced by theater students when using scripts, either partially or entirely, for their performances. To achieve this, a literature review will be conducted to examine the concept and reg ulations of fair use in copyright law, and to understand the scope of fair use. Additionally, a com parative analysis of the fair use provisions in U.S. and South Korean copyright laws will be conducted to draw implications and propose institutional improvements for resolving copyright issues in uni versity theater performances. Through a clear interpretation of the fair use doctrine, this study seeks to complement the limitations of abstract legal principles, enabling aspiring artists to predict the ap plication of fair use in their creative endeavors. Ultimately, this research aims to contribute to the activation of college theater performances, which can serve as a foundation for the development of culture and arts.
