대한제국기 務安監理 秦尙彦의 반침략 외교활동 (The Diplomatic Activity of Jin Sang-Eon(秦尙彦) against Imperial Disseisin by Russia and Japan during Korean Empire)

초록

秦尙彦은 일찍이 중인 집안 출신으로 譯科를 거쳐 出仕하였다. 그는 1880년대에 개화정책 수행을 위한 청국 시찰단인 領選使行에 선발된 뒤 統理交涉通商事務衙門 主事로 임명되어 근대적 외교인력의 풀로 활동하였다. 주로 監理와 군수 등 지방관직을 주로 역임하며 아주 고위관직까지는 이르지 못했지만, 1897년 목포 개항과 더불어 務安監理로 임명되어 제국주의 열강들의 경제적 침탈에 대응하는 최일선에서 활동하였다. 그는 취임 일성으로 이전에 개항장에서 관직들을 역임하며 문제의식을 느꼈던 것으로 추정되는 외국인 토지매매와 관련된 규정을 제정하였고, 三鶴島 사건이나 租界地 내 공사에 대한 외국인의 방해 시도 등에 있어서 분명한 한계 속에서도 시종일관 한국인의 편에서 사건을 처리하려 노력하였다.
1897년에 러시아가 木浦 영사관 부지 매입 과정에서 高下島 구입을 시도하자 그는 조계 밖 10리 이내라도 바다로 둘러싸인 곳은 외국인에게 매매할 수 없다는 이유로 이를 거부하였고 처음에는 중앙의 外部에서도 이에 호응하였다. 그러나 애초에 조약에 해당 조항이 없어서 불리한 입장이었던 한국 정부는 러시아 측의 집요한 요구에 결국 굴복하였다. 이후 러시아 측이 섬의 일부 토지를 매입한 뒤 그에 대한 地契 인증을 요청하자 마찬가지로 진상언은 거부했다, 하지만 매매 과정에서 석연찮은 부분이 있음에도 정부의 입장은 이미 허가해주는 쪽으로 바뀌어 있었다. 이에 진상언은 자신의 관할구역이 아니라는 다소 억지 논리로 지계 발급을 거부했으나 러시아 측의 계속되는 압박과 외부의 힐책으로 점차 고립되어 갔다.
한편 일본도 러시아에 자극받아 고하도 매입을 추진했는데, 먼저 李允用 명의로 구매한 뒤 일본인에게 넘기는 형태로 은밀하게 진행하였다. 결국 임대의 형태로 계약을 체결한 뒤 고종의 허락을 받았고, 이를 바탕으로 진상언에게 이 사실을 공개하며 인증을 요구했으나 그는 영사관의 공문 수령 자체를 거부하며 강경하게 나왔다. 이에 일본 측에서 강력하게 항의하며 진상언의 처벌을 요구하였고, 또다시 방문한 러시아 관원의 지계 발급 요청을 마찬가지로 ‘관할 논리’로서 거부한 그에 대해 러시아에서도 강력히 항의하여 罰俸 처분을 받기에 이른다. 이후 그는 러시아 측이 지계 발급을 위해 고하도를 방문했을 때에도 부지의 면적 문제로 대립하다가 결국 면직 처리되고 말았다. 그의 행위는 당시 기준으로 볼 때는 자신의 관할을 남에게 미루는 직무유기였지만, 한국을 둘러싼 러·일간의 치열한 제국주의 쟁탈전이라는 당시 상황을 놓고 생각하면, 중앙정부가 도와주지 않는 상황에서 나름 자신의 관점에 따라 국가의 미래를 바라보며 외국의 토지침탈을 저지하려는 행동의 일환으로 볼 수 있다.

영어초록

Jin Sang-Eon(秦尙彦), belonging to Jung-in(中人) class, entered government service through Yeok-Gwa(譯科; civil service examinations for the interpreters). He was selected as a member of the Youngseon-Sa(領選使; delegation sent to China for learing technology of modern weapons), and after that appointed as Jusa(主事) of Tongni-Gyosep-Tongsang-Samuamun(統理交涉通商事務衙門; Ministry of Foreign Affairs) in 1880s, meaning his activity in the field of the modern diplomacy of Korea. He mainly served as local governors like Gamri(監理; Superintendent of the treaty ports and open markets) and Gunsoo(郡守; a county headman), and could not reach the high-ranking officials in the central government. But he was on the forefront of counteracting imperial economic invasion as Gamri of Mu-an(務安) port at the opening of the port in 1897. He made the regulation to restrict the landholding by foreigners, maybe originated from his awareness of the problem made during his public service at the other treaty ports like Incheon. And he tried to handle every criminal and civil disputes on the side of Koreans under obvious limitation.
When Russia tried to buy Goha-do(高下島; Island of Goha) in the course of purchasing the land for Consulate at Mok-po(木浦) in 1897, Jin Sang-Eon refused it on the ground that the place surrounded by seas could not be sold to foreigners, even though located within 10-ri(里) from a foreign concession. And Korean Ministry of Foreign Affairs also supported him at first. But the exceptive clause for 10-ri limit had not been stipulated in the treaties, meaning the position of Korean government to foreign countries was disadvantageous, finally making it yield to the tenacious requests of Russia. After that, Russian Legation of Korea purchased some part of the island and demanded the approval of the contract note. Jin Sang-Eon refused it again, but this time Korean Government ordered him to approve it despite the doubt of that deal. Then he insisted to refuse on the ground of being beyond his jurisdiction. gradually isolated by continuous pressure of Russia and rebuke from Korean Foreign Ministry.
Japan also pushed ahead with purchasing the island, stimulated by Russia. The deal was made confidentially, in the dual form of first purchase in the name of Yi Yoon-yong(李允用) and second nominal transfer to Japanese. The contract was made in the form of 30-year rent, and permitted by Emperor Gojong. So Japanese Consul requested the approval of their ownership for the island to Jinsang-Eon, but he didn’t agree on it and refused to accept Japanese official document itself. At this Japanese Legation protested to Korean Government and demanded to punish him, while Russia requested same one because Jin Sang-Eon refused to issue the certificate of land ownership for Russia under the same ground of jurisdiction again. These finally made his docking of salary as a penalty. Hereafter he stood up to Russian once more from the matter of the land dimensions, which ultimately caused his dismissal. His act is of course dereliction of duties, but from a different standpoint also an action of blocking the foreign disseisin under his own thinking about the future of his country without its aid.
