인천시 문화재 지정 문제점에 대한 연구- 김취려 묘, 이승훈 묘를 중심으로 - (A Study on the Problems of Designating Cultural Heritage in Incheon - Focusing on Kim Chi Ryeo's tomb, Lee Seung Hoon’s tomb -)

초록

최근 인천시 지정 문화재에 대해 문화재 지정 자체와 문화재 가치 등에 대해 민원이나 소송을 제기하는 사례들이 있다. 그런 것들은 제대로 된 정보와 문화재 지정에 대한 오해로 인한 것들이 대부분이겠지만, 일부는 문화재 지정 절차 등의 행위를 적절하게 하지 못한 것으로 인한 것들도 있다.
필자는 인천시 문화재 중 문화재자료로 지정된 김취려 묘와 기념물로 지정된 이승훈 묘의 지정 관련 내용과 지정 고시 등을 통해서 2개 문화재에 대해 일반인들이 가질 수 있는 문제점들을 조사, 분석해 보았다. 아쉽게도 2개 문화재의 지정 과정과 관련된 조사 자료나 문화재위원회 회의록 등을 인천시 담당 부서에서 모두 제공해 주지 않은 상태에서 한 검토라서 부족한 부분이 있을 수 있다. 그런 점들을 감안하더라도 일반인의 입장에서 몇 가지 점들은 개선하고 시정되어야 할 것으로 판단하였다.
첫째, 2개 문화재 모두 문화재 지정 가치 여부에 대해 명확하게 밝히지 않았다는 사실이다. 곧 정확하게 어떤 점들이 해당 문화재로 지정할만한 가치가 있는 것인지를 고시에서 밝히지 않아 일반인이 왜 그것이 문화재인지를 알 수가 없다.
둘째, 지정 문화재의 현재 상태 등을 고려할 때 문화재 명칭을 재검토할 필요가 있다고 보았다. 김취려 묘는 언제 지금의 모습을 하게 된 것인지 명확한 근거 자료를 제시하지 않았으면서도 한편으로는 고려 시대 석물이 존재한다고 말하면서 『문화재보호법』에서 국가 지정 문화재와 시·도 지정 문화재로 분류하지 않는 문화재자료로 지정하였다. 그리고 이승훈 묘는 ‘가묘’인 점을 고려하여 문화재 명칭을 재검토할 필요가 있다.
셋째, 문화재로서 지정, 보존할 대상이 무엇인지가 정확하게 적시되지 않았다. 김취려 묘와 이승훈 묘 모두 묘가 있는 토지만 역사성을 인정하여 문화재로 지정, 보존할 대상인지 아니면, 묘역 내부에 있는 석물 등도 문화재인지를 명확하게 적시하지 않았다는 점이다.
향후 2개 문화재는 당연히 문화재 지정 가치에 대한 재조사와 그에 따른 수정 고시가 필요하다. 나아가 현재 지정된 문화재들에 대한 전수 조사를 통하여 문화재 지정 가치 여부 등에 대해 고시에서 제대로 적시되어 있지 않은 문화재들과 문화재 여부가 명확하게 적시되지 않은 문화재들을 파악하여 수정, 보완하여야 한다. 그렇게 하여야 인천시민들은 물론 국민들이 인천시 문화재 행정에 대해 신뢰하고 인천시 지정 문화재들을 자발적으로 보존, 관리하려고 할 것이라고 생각한다.

영어초록

Recently, there are cases of filing complaints or lawsuits against the designation of Cultural Heritage itself and the value of Cultural Heritage designated by Incheon City. Most of these may be due to proper information and misunderstanding of the designation of Cultural Heritage, but some are due to failure to properly perform actions such as the procedure for designating Cultural Heritage.
I investigated and analyzed the problems that the public may have with the two Cultural Heritage through the designation of Kim Chi Ryeo’s tomb, designated as a 문화재자료(Cultural Heritage Data), and Lee Seung Hoon’s tomb, designated as 기념물(Monument), among the Cultural Heritage of Incheon. Unfortunately, the review was conducted without the Incheon Metropolitan Government’s department providing all the survey data or the Conference record of the Cultural Heritage Committee related to the designation process of the two Cultural Heritage. Even considering those points, it was judged that some points should be improved and corrected from the perspective of the general public.
First, it is a fact that neither of the two Cultural Heritage clearly stated whether or not they are worth designating as Cultural Heritage. In other words, the notification did not reveal exactly what points were worth designating as Cultural Heritage, so the general public cannot know why they are Cultural Heritage.
Second, considering the current status of designated Cultural Heritage, it was considered necessary to review the name of Cultural Heritage. Kim Chi Ryeo's tomb did not provide clear evidence of when it became what it is now, but on the other hand, it was designated as 문화재자료(Cultural Heritage Data) that was not classified as a state-designated Cultural Heritage and a city/province-designated Cultural Heritage under 「문화재보호법(Cultural Heritage Protection Law)」. And it is necessary to review the name of the Cultural Heritage in consideration of the fact that Lee Seung Hoon's tomb is a “fake tomb.”Third, it was not accurately indicated what was designated and preserved as a Cultural Heritage. Both Kim Chi Ryeo's tomb and Lee Seung Hoon’s tomb did not clearly indicate whether only the land with the tomb was designated and preserved as a Cultural Heritage in recognition of its historical nature, or whether the stone inside the tomb was also a Cultural Heritage.
In the future, it is necessary to re-examine the value of the designation of Cultural Heritage and revise the notification accordingly. Furthermore, through a full survey of currently designated Cultural Heritage, Cultural Heritage that are not properly specified in the notification as to whether or not they have Cultural Heritage designation value, and Cultural Heritage that are not clearly specified Whether it is a Cultural Heritage, must be identified, corrected, and supplemented. In doing so, I think Incheon citizens as well as the people will trust the administration of Cultural Heritage in Incheon and voluntarily preserve and manage Cultural Heritage designated by Incheon.
