본 연구는 전병훈의 정치철학을 중심으로 20세기 초 동서의 사유가 접변하던 시기에 조선 지식인의 ‘예치(禮治)’에 대한 시각을 탐색했다. 전병훈은 구한 말에서 일제강점기 기간에 조선과 중국 북경에서 활동한 조선 지식인이다. 중국 북양군벌 시기에 북경에서 활동하던 전병훈은 동서의 정신철학, 심리철학, 도덕철학, 정치철학 사상을 융합한 『정신철학통편(精神哲學通編)』(1920)을 저술했다. 그는 「정치철학」편에서 동서고금의 정치철학을 다루고 있는데, 여기서 ‘예치’는 서구가 본받아야 할 정치 제도이자 도래할 미래에도 수행되어야 할 가치를 지닌 동아시아 정치철학의 핵심으로 거론된다. 전병훈의 정치철학에서 예치는 크게 두 층위를 지닌다. 하나는 『주례』의 ‘독법규칙’을 사례로 제시한 ‘주공의 예치’다. 이는시대에 따라 변통 가능한 예법(禮法)으로서의 예치로, 성왕군주의 교화(敎化)를 통한 풍속 변화를 목표로 하는 것으로서 유교 전통의 자장에 속해 있는 예치이다. 다른 층위의 예치는 ‘공화 헌법의 예치’다. 이는 동서의 정치철학 사유가 조제된 결과 새롭게 해석된 예치로서 공화, 민주, 헌법의 가치가 부여되어 있다. 전병훈에 의해 새롭게 해석된 예치는 인민들의 뜻과 인민들 상호 계약에 따라 법적 절차가 규정된 예치로서, 주권을 가진 개개인의 사회적 합의를 통해 형성된 사회 질서 규범으로서의 의미가 담겨 있다고 평가할 수 있다.

영어초록

This study explored the perspective of Joseon intellectuals on “Propriety-politics” at a time when East and West thoughts were in contact in the early 20th century, focusing on Jeon Byung-hoon's political philosophy. Jeon Byung-hoon was a Joseon intellectual who worked in Joseon and Beijing during the Japanese colonial period from the end of the Joseon Dynasty. Jeon Byung-hoon, who was active in Beijing during the Northern Warlords period in China, wrote General Edition of Mental Philosophy in 1920, which combines the ideas of the East and West, mental, psychological, moral, and political philosophy. In the “Political Philosophy” section, he deals with the political philosophy of the East and West, where propriety-politics is mentioned as the core of East Asian political philosophy, which is a political system that the West should emulate and have values to carry out in the coming future. In Jeon Byung-hoon's political philosophy, the Propriety-politics differs by two levels. One is the ‘Propriety-politics of Zhougong 周公’ based on the case of The Rituals of Zhou (Zhouli 周禮). This is a propriety-politics that can be changed according to the times, and it is a deposit that belongs to the field of Confucian tradition as it aims to change the customs through the edification of the Holy Prince. The other is ‘Propriety-politics of Republican Constitution.’This is a newly interpreted propriety-politics as a result of the preparation of political philosophy thoughts of East and West, and the value of republican, democracy, and constitution is given. The propriety-politics newly interpreted by Jeon Byung-hoon is a propriety-politics that stipulates legal procedures according to the will of the people and mutual contracts of the people, and can be evaluated as having meaning as a social order norm formed through social consensus of individuals with sovereignty.
