통일헌법의 이념적 기반과 제정의 원칙들 (The Ideological Foundation of The Unification Constitution and The Principles of Its Enactment)

초록

세계사적 지평 속에서 분단국가들의 통일은 ‘최소’ 분단국가들의 헌법 개정으로부터, ‘최대’ 통일국가의 새로운 헌법의 제정까지를 필수적으로 요구해왔다. 독일통일은 서독기본법 제23조의 편입조항에 의해 규범적으로 실현될 수 있었고, 예멘통일은 남북예멘이 서로 합의하여 통일헌법을 채택함으로써 완성될 수 있었다. 한반도 통일과 헌법을 연관시킨 연구들의 활발한 전개 역시 이러한 1990년대 동서독과 남북예멘의 통일국가 수립이라는 계기들로서 시작되었다. 그러나 독일 통일의 사례가 우리에게 결코 선도적 모델이 될 수 없다는 평가는 이미 일반적이다. 따라서 중요한 것은 무엇보다 통일헌법의 이념적 기반과 원리 등에 대한 모색이 우선시 되어야 한다는 점이다.
이러한 입장에서 본 논문은 통일헌법의 가치와 근본이념, 나아가 통일헌법 제정의 방법론적 원리를 다루고 있다. 여기에는 통일헌법이 도래할 미래의 공동체를 만들어갈 수 있는 수행적 힘을 가지고 있으며 우리들에게 실천적 규범력을 제공할 수 있다는 믿음이 전제되어 있다. 구체적으로 통일헌법의 가치지향은 ‘과정으로서의 통일’과 ‘정치적 주체의 복원’이라는 과제를 수행한다는 의의를 갖는다. 또한 통일헌법의 근본이념은 이념적 포용력을 갖춘 ‘민주주의 그 자체’가 되어야 한다. 마지막으로 통일헌법 제정의 방향성은 분단체제의 직접적인 폭력과 적대적인 공생관계 속에서 고통 받은 주권자들에 대한 ‘치유’ 및 그것의 재발에 대한 철저한 반대지향을 선포해야 한다는 점이다.

영어초록

In world history, unification of the divided nations has been requisitely required from the revision of the Constitution of the 'minimal' divided nations to the establishment of the new Constitution of the 'maximum' unified nation. The unification of Germany could be realized normatively by incorporation clause under Article 23 of the Basic Law of West Germany(Grundgesetz für die Bundesrepublik Deutschland). And unification of Yemen could be completed by adopting the Unification Constitution with mutual agreement between South and North Yemen. The active development of studies related to the unification of the Korean Peninsula and the Constitution also began in the 1990s as opportunities for the establishment of the unified nation of East-West Germany and South-North Yemen. However, it is already common that the case of reunification of Germany will never be a leading model for us. Therefore, What is important is that consideration about the ideological bases and principles of the Unification Constitution should be sought first.
From this point of view, this study deals with the value and root idea of the Unification Constitution, and, moreover, its methodological principles for the enactment of the Unification Constitution. It is assumed here that the Unification Constitution has the practical power to create a community of the future, and it can provide us with practical norms. To put it concretely, the axiology of the Unified Constitution has meaning to carry out the task of 'unification as a process' and 'restoration of political subjects'. Also, the root idea of the Unification Constitution should be 'democratic itself' with ideological tolerance. Finally, the direction of the enactment of the Unification Constitution is that it should declare “healing” and its thorough prevention of recurrence against the suffering sovereigns under the direct violence of the division system and hostile symbiotic relationship.
