인정(仁政)에 대한 두 학자의 시선 − 정도전(鄭道傳)과 방효유(方孝孺)의 법사상을 통해 바라본 유학사상의 중핵(中核) − (Two Scholars' Perspectives on the politics of benevolence - A Central Core of Confucian Thought through the Legal Thought of Jeong Do-jeon and Fang Xiaoru)

초록

필자는 서로 만난 적도 없는데 정도전과 방효유의 사상이 한 사람에서 나온 것 마냥 비슷한 것은 인정(仁政)에 대한 두 사람의 열정과 신념이 같아서이기 때문이라고 판단한다. 그러한 열정과 신념은 두 사람 각각 귀양이나 무위(無位)로 고난을 맞았던 시기에 무학의 백성들과 함께 동락했던 경험에서 비롯하였고, 그러한 실존적 경험이 경전을 창의적으로 수용하여 인정(仁政) 사상의 토대를 만든 힘이었다고 본다.
정도전과 방효유가 공유하는 사상의 중핵에 인정(仁政)이 있고, 인정을 해야 하는 당위성에 성선설이 자리한다. 두 사상가는 사람이라는 존재와 그 가치를 진정으로 신뢰한다. 두 사상가가 구상한 인정의 유교적 질서에서 민(民)은 인(仁)의 가능성을 선천적으로 부여받은 보편적이면서 가장 근원적 존재이기 때문이다. 유교사상의 가장 오래되고 보편적인 개념 두 개만 꼽으라면 바로 강충(降衷)과 병이(秉彝)일 것이다. 이 두 개념은 천지생물지심(天地生物之心)을 닮은 불인인지심(不忍人之心)으로 구체화하여 사람과 사물을 사랑으로 대한다. 정도전과 방효유는 공통적으로 이 마음을 회복하는 것이야말로 치밀한 법으로 사람을 옥죄는 것보다 근원적이며 건강하다고 주장했다. 필자는 두 사상가의 법사상에서 놀랍도록 공통된 부분을 발견하여 가급적 구체적으로 기술하고자 했다. 『삼봉집(三峰集)』과 『손지재집(遜志齋集)』의 비교를 통하여 두 사상가를 관통하는 공통의 관심이 인정(仁政)의 실현에 있음을 확인했고 그것은 우리시대에도 여전히 유효한 가치임을 말하고자 한다.

영어초록

There is not a single person in Korea who does not know about Sambong (三峰) Jeong Do-jeon (1342∼1398). It is rare to find a thinker and politician who made such a strong impression during his 57 years of life, and the reason why he is so famous to us is that he has been repeatedly imprinted on the public through various dramas and movies since 1983. However, there was another man who lived in a different space at the same time, the Sunzhi, Fang Xiaoru (1357∼1402). He died at the age of 46, shorter than Jeong’s 57-year lifespan. Similarly, it’s rare to find a Chinese person who doesn’t know Fang Xiaoru. This is because Fang Xiaoru has been featured in various dramas and movies related to the Ming dynasty’s Zhu Mingzhang (朱元璋, 1328∼1398), the second Huizong Zhu Yuanwen (朱允炆), and the third Chengzu Zhu Di (朱棣, 1360∼1424).
I believe that behind the similar thought processes of Jeong Do-jeon and Fang Xiaoru is a passion for and belief in justice. These passions and convictions stemmed from their experiences of living with the people of the uneducated, who are very nice, during the period of exile and displacement, and I believe that these existential experiences laid the foundation for their creative interpretation of the scriptures.
Recognition is at the heart of the ideas shared by Jeong Do-jeon and Fang Xiaoru, and the justification for recognition is at the heart of Theory of man’s inherent good. In the Confucian order of recognition envisioned by both thinkers, the people are the universal and most fundamental beings who are innately endowed with the potential for humanity. Two of the oldest and most universal concepts in Confucianism are the concepts of Jiangzhong (降衷, the right way from heaven) and Bingyi (秉彝, certain law of heaven). These two concepts are embodied in the heart that people dare cannot do, which resembles the heart from which heaven gave birth to things, and treats people and things with love. Both argued that restoring this heart is more fundamental and healthier than imprisoning people with elaborate laws. I have found surprising similarities in their legal thought and have tried to be as specific as possible. Through the comparison of two thinkers, I have found that the common interest that runs through both thinkers is the realization of justice, which is still a valid value in our time.
