초록

영국 노동당 정부는 영연방과 영제국 전체를 하나로 묶어주던 ‘공통 국적 규범’이 영연방 민족주의를 반영한 1946년 캐나다 시민권법에 의해 와해될 위기에 처하자, 1948년 영국 국적법을 만들어 새로운 ‘공통 국적 규범’을 제공함으로써, 연방과 식민지의 결속과 여기서의 영국의 지도력을 강화하여 영국의 국제적 위상을 유지하려 했다. 이제 영연방과 식민지인들은 왕에 대한 충성의 대가로 영국 신민 신분과 이에 수반된 권리를 왕에 의해 부여받는 것이 아니라, 공동체의 구성원이 됨으로써 획득한 시민 자격에 기초하여 선거권과 각종 시민권을 동등하게 누리고 영국 신민 신분과 영국 국적도 유지하게 되었다. 그러나 정부와 의회는 이 법이 영연방의 결속을 유지하도록 만드는 데 전념하느라 시민/시민권이란 용어를 명확한 개념 정의 없이 사용했는데, 이는 이 법에 의해 선거권과 여타 시민권이 공화주의적인 의미에서 영국에서는 처음으로 법제화 된 점이 이 법의 의도하지 않았던 부산물이란 사실을 보여주는 것이다. 또한 이들은 영국과 식민지와의 결속 강화를 위해 (구) 연방보다 열등하게 여기는 식민지(와 신 연방)의 비브리튼 유색인에게도 영국으로 올 경우 영국인과 동등한 선거권과 여타 시민권을 보장했는데, 1940년대 후반 이후 예상치 못했던 영국의 경제발전으로 인한 노동력 부족으로 인해 본래 의도와 달리 이런 유색인 이민이 급증했다.

영어초록

The Canadian Citizenship Act of 1946 which was a reflection of nationalism arising among the old Dominions posed a serious threat to the basis of the ‘common code’ which has unified the British Commonwealth of Nations and the British Empire. The British Labour government and Parliament passed the British Nationality Act of 1948 which they hoped, by maintaining a uniform definition of British subjecthood, would both intensify the unity among the Commonwealth nations and the British Colonies and affirm Britain’s place as their head, thereby maintaining Britain’s international position in the postwar era. As a result, people of the Commonwealth and the Colonies, by means of their status as citizens stemming from their respective community membership, could now enjoy equal franchise and other citizenship rights and maintain their existing British subjecthood and British nationality.
The Nationality Act established for the first time in British history franchise and other citizenship rights as republican legal rights. However, ironically, the political elites in the government and Parliament, being greatly engrossed in the task of making the Act help maintain the bonds among the Commonwealth nations, used the terms of ‘citizen’ and ‘citizenship’ without providing their exact definitions. Meanwhile, for the purpose of strengthening the ties between Britain and its Colonies, the political elites guaranteed the same franchise and other citizenship rights as Britons enjoyed in the United Kingdom to its non-Briton colored British subjects if they entered the United Kingdom. Contrary to their expectation, however, such colored migration to the United Kingdom rapidly and greatly increased since the late 1940s due to the unexpected changes in postwar economic conditions, chiefly the labor shortage brought about by the achievement of full employment in the United Kingdom and the availability of cheap international transportation.
