나노기술과 새로운 윤리 모델의 모색 - 사전예방원칙을 넘어서 - (Nanotechnologies and Possibility of the New Way of Ethics—Beyond the Precautionary Principle—)

초록

자연환경과 미래세대에 끼칠 불확실성을 근거로 특정한 기술에 대한 현재의 적극적인 금지조치를 정당화하는 사전예방원칙’은 나노기술을 중심으로 융합하는 첨단 신생과학기술의 등장으로 새로운 도전에 직면하고 있다. ‘사전예방원칙’을 나노기술과 같은 첨단 신생과학기술을 진행방향과 속도를 통제하기 위한 윤리 및 법 규범의 근거로 삼으려고 한다면, 기존의 비용편익분석과 리스크관리를 넘어서는 새로운 윤리적 정당화가 필요하다. 나노기술이 제기하는 불확실성에는 시간적 격차에서 오는 불확실성뿐 아니라 인간능력향상을 통해 인간과 인간, 인간과 자연의 관계 자체가 변화하는 데서 오는 불확실성이 포함되어 있기 때문이다. 따라서 나노기술에 적용되는 사전예방원칙을 기존의 인간관계를 전제로 하는 전통적인 윤리를 통해 정당화하기는 어렵다. 한스 요나스의 책임원칙은 전통적인 인간중심적 윤리를 생명중심적 윤리로 확장하여, 미래세대와 자연생태계로 인간의 책임을 확장한다. 이것은 환경윤리에 있어서 전통적인 공리주의나 의무주의가 리스크 관리의 정당화에 그치는 것과 달리, ‘사전예방원칙’을 윤리적으로 정당화할 수 있는 가능성을 보여준다. 하지만 요나스의 생명중심주의 역시 생명체의 합성이나 인간 수명의 극단적 연장을 예상하는 나노기술의 불확실성에 대답하기 어렵다. 본 논문은 1장에서 사전예방원칙의 발생 배경과 리스크 관리와의 관계를 살펴보고, 2장에서 나노기술과 같은 첨단 신생과학기술에 이 원칙을 적용할 때의 한계를 살펴본 다음, 3장에서 사전예방원칙에서 요나스의 책임원리가 갖는 의미와 한계를 지적하려고 한다. 이를 통해 현재의 윤리 모델이 갖는 한계를 넘어서는 새로운 윤리 모델의 필요성을 모색하려고 한다.

영어초록

The precautionary principle which is justifying the ban of technologies, is based on the uncertainty of harms on future generations and natural environments. But now it is facing new challenges with the emergence of new emerging technologies which is combined with nanotechnology. If we take the ‘precautionary principle’ as ethical and legal basis of controlling the direction and speed of the new emerging science and technology such as nanotechnology, there is a need for a new ethical justification beyond the traditional cost-benefit analysis and risk management. Because the uncertainties raised by nanotechnology is not only the uncertainty comes from the temporal gap, but also uncertainties that, through increased human capacity, come from changes of the relationship itself between man and man, man and nature. Therefore, the precautionary principle applied to nanotechnologies, is difficult to be justified by the traditional ethics which is premising the existing human relationships. Hans Jonas’s responsibility principle is to expand the traditional anthropocentric ethics to life-centered ethics, and expand the human responsibility to future generations and the natural ecosystem. This is unlike traditional utilitarianism or deontology which is justifying environmental ethics only on the ground of risk management, and shows the potential to ethically justify the ‘precautionary principle’. But the life-centered ethics of Jonas is also difficult to answer the uncertainties of nanotechnology, because nanotechnology is expecting on a synthesis of life and extreme continuation of human life. In Chapter 1, this paper examines the background the occurrence of the precautionary principle and the relationship between the precautionary principle and risk management. And in Chapter 2, we will discuss the limitations of this principle when applied to the new emerging science and technology, such as nanotechnology. And then in Chapter 3, it tries to point out the significance and limitations of the principle of responsibility of Jonas in justification of the precautionary principle. Through this attempt, we are to explore the need for a new ethical model beyond the limits of the current ethical model.
