己亥禮訟을 통해 본 조선 성리학의 공사론 (Theory of the public and the Private of Neo-Confucianism in Korea: focusing on GihaeYesong)

초록

본 연구의 목적은 조선 성리학자들 중 서인과 남인 사이에서 일어났던 예송논쟁을 통해, 그들이 정당화하고자 했던 주장의 근거를 확인하고 그것이 담고 있는 철학적 원리가 무엇인지 분석함으로써 조선 성리학의 공사관(公私觀)을 규명하는 것이다. 특히 기해예송 논쟁에서 나타나는 임금과 국가에 대한 윤휴의 입장이 송시열의 입장과 어떻게 다른지, 그 연원을 분석한다.
유학의 공사관은 가(家)와 국(國)이라는 영역의 차이로 결정되기보다는 도덕적 태도로 결정된다. 정치영역이라고 해서 공적인 것인 것이 아니고 가정이나 개인적인 영역이라고 해서 사적인 것이 아니다. 개인이 가(家)에서든 국(國)에서든 간에 공적 태도를 취하면 그 사태는 공적인 것이 되고 사욕에 따른 태도를 취하면 사적인 것이 된다. 이런 맥락에서 볼 때, 혈연관계에 따른 행위를 한다고 해서 사적인 것이 되는 것이 아니다. 혈연관계에서 천리(天理)에 따르는 태도로 행위를 하면 공적인 것이 되고 혈연관계에서 사욕을 위해 행위를 하면 사적인 것이 되는 것이다. 마찬가지로 국(國)의 임금이 천리(天理)에 따르지 않고 사욕을 위해 행위를 하면 사적인 행위를 하게 되는 것이다.
기해예송에서 송시열이 가례(家禮)의 논리로 예법을 적용하려고 한다고 해서 사적인 논리로 접근하는 것이 아니고, 윤휴가 고례(古禮)의 논리로, 즉 제후와 천자의 예법을 별도로 적용하려고 한다고 해서 공적인 것이 되는 것이 아니다. 송시열과 윤휴의 예송논쟁은 유학에 본래 내재하고 있는 두 가지 측면 중 어느 것을 중시하느냐에 따라 발생한 것이다. 유학의 핵심 사상은 인(仁) 사상이고 인(仁)의 실천적 덕이 효(孝)이다. 유학은 인(仁)이 우주의 보편적 원리로서 천리(天理)와 일치된다는 구조로 이루어져 있다. 퇴계철학을 계승한 윤휴는 천명(天命)을 받은 임금의 특수성을 상대적으로 강조하여 임금에 대한 예법을 사대부와 다른 논리를 적용하려고 했고, 송시열은 인(仁)의 혈연적 예법을 상대적으로 강조하여 가례를 적용하려고 했다.

영어초록

The purpose of this study was to investigate perspectives of public-private Neo-Confucian scholars in Joseon dynasty by confirming the basis of the arguments they wanted to justify through the Yesong-debate that took place between Seoin(西人) and Namin(南人), and analyzing the philosophical principles contained therein. In particular, it analyzes how Yun-Hyu's position on wages and the state appearing in the debate on GihaeYesong differs from that of Song Si-yeol, as well as the different origins.
Perspectives of public-private of Confucianism is not determined by the difference of domain between the family(家) and the country(國) but determined by the moral attitude. The political domain is not public, and the home or personal domain is not private. Regardless of whether an individual is in the family(家) or country(國), it becomes public when he or she adopts a public attitude, and when an individual adopts an attitude that follows self-interest, it becomes private. In this context, just because you act according to blood ties does not make you private. In a blood relationship, if you act in an attitude that follows natural raw, it becomes public, and if you act for self-interest in a blood relationship, it becomes private. Likewise, if the king of the country(國) does not obey natural law and acts for self-interest, then it is a private act.
In GihaeYesong, Song Si-yeol tried to apply the courtesy with the logic of the family centering on ‘confucian ritualism of the family(朱子家禮)’, not as a private logic, but Yunhyu tried to apply the national logic of ‘old manners(古禮)’, that is, just because he try to apply manners of feudal lords or an emperor separately, it does not make it public. Song Si-yeol and Yun-hyu's dispute on courtesy came about depending on which of the two aspects inherent in Confucianism was emphasized. The core idea of Confucianism is the idea of benevolence(仁), and the practical virtue of benevolence is filial piety(孝). Confucianism consists of a structure in which benevolence are consistent with natural law as a universal principle of the universe. Yun Hyu, who inherited the Toegye philosophy, tried to apply a different logic to the courtesy of wages unlike gentry(士大夫) by relatively emphasizing the peculiarity of wages that received doctrine of heaven(天命). Song Si-yeol tried to apply the rite by relatively emphasizing the blood-related manners of humanity.
