조선시대 胡亂 被擄人과 두 딜레마 (Two Dilemmas in Coping with Captive Affairs of the Manchu Invasions in the Joseon Dynasty: Conflicts between Jing(經) and Quan(權))

초록

본고에서는 17세기 조선왕조가 직면한 두 딜레마와 그에 대한 대처를 검토했다. 만주족(滿洲族, 淸)의 침공으로 인하여 주회인(走回人) 문제와 환향녀(還鄕女) 문제가 떠올랐는데, 이 두 문제는 너무나 예외적인 상황이어서 유교 사회의 정치 전반을 규율하는 일반 원칙으로는 해결하기 어려웠다.
‘주회인’이란 호란의 와중에 淸에 잡혀갔다가 감시가 소홀한 틈을 타고 도망쳐서 조선으로 돌아온 사람들을 말한다. 淸에서는 조선에 ‘주회인들을 쇄환(刷還)하라’고 요구했다. 그러나 조정에서 주회인을 쇄환한다는 것은 그 자체 도리에 어긋나는 일이었다. 더군다나 주회인을 쇄환하면 백성들의 원성이 하늘을 찌를 것이었다. 그러나 淸의 요구를 무시하면 가혹하게 보복할 것임은 뻔한 일이었다. 이러한 맥락에서 주회인 문제는 조선에 매우 난처한 문제였다.
‘환향녀’란 역시 호란의 와중에 淸에 잡혀갔다가 속환된 여인들을 말한다. 그런데 이들이 고향에 돌아오자, 주위에서는 이들을 ‘오랑캐에게 정절을 잃은 여인[失節女]’이라 하여 멸시하는 분위기가 팽배했다. 특히 사대부가(士大夫家)에서는 환향한 여인을 아내(며느리)로 인정할 수 없다고 주장하며, 조정에서 이혼을 허락해줄 것을 요구하는 사례가 많았다. 환향녀들의 딱한 사정에 대해 직접적인 책임이 있는 조정으로서는 쉽게 이혼을 허락할 수 없는 처지였으나, 가문의 혈통을 순수하게 보존하겠다는 사대부들의 요구를 무시하기도 어려웠다. 이러한 맥락에서 환향녀 문제 역시 조선 조정에 매우 난처한 문제였다.
극히 예외적인 상황을 마주할 때 유교윤리는 권도(權道)를 사용하도록 지침을 준다. 그러나 권도의 사용은 신중해야만 하며, 권도로서도 정당화되기 어려울 경우 조치는 단순한 권모술수(權謀術數)에 지나지 않게 된다. 그 결과 권도를 사용하는 과정은 권도를 사용할 상황인지, 어떤 권도가 가능할지를 둘러싼 열렬한 논쟁의 과정이다. 본고에서는 주회인 문제와 환향녀 문제에 대하여 조선 조정이 각 문제를 어떻게 인식했으며, 어떤 권도를 제시하고 또 그것을 어떻게 정당화했는지를 고찰해 보았다.

영어초록

This article explores two dilemmas that the Joseon Dynasty faced at the beginning of the 17th Century and how it responded to them. The issues of the fugitive captives and the repatriated ladies respectively arose as a result of the Manchu Invasion. These issues were so exceptional that they could not be handled with ordinary principles which regulate the Confucian society and politics.
The fugitive captives were the military or civil prisoners during the invasions who made a furtive escape by themselves from Manchu then returned to Joseon. Manchu was so indignant that they insisted Joseon should extradite the fugitives to Manchu again or pay the ransom. If Joseon returns the fugitives to Manchu, the people of Joseon would be so upset that they betray or further abandon the country. In addition, it is also an unacceptable violation of the principle of righteousness, nevertheless, another harsh invasion seems inevitable if the demand dismissed. In this context the court of Joseon was driven into a quagmire.
The repatriated ladies were also female war prisoners who were repatriated to their own country, Joseon. However, they were scorned by the society of Joseon, with being suspected that they had lost their fidelity to their husband and family. Houses of the ruling literati class in particular, asked royal permission for divorce against their daughters-in-law. Considering the miserable circumstances that the repatriated had endured, the court could not allow itself to permit divorces, on the one hand, the strong-headed claim, in an effort to guarantee their blood purity among the ruling class, on the other hand, was also never easy to dismiss at once. In this regard, the issue of repatriated ladies also pushed the court of Joseon into a tight corner.
When facing an extraordinary situation, the Confucian ethics instructs to use Quan(權) rather than Jing(經). Practicing Quan, however, ought to be prudent and cautious, otherwise, it merely becomes a ruse in that the action has failed to be justified as a Quan. Thus, the whole process of Quan application is a series of controversies over if it is a due situation which necessitates Quan or what sort of Quan can be taken advantage of here. This article analyzes how the court of Joseon understood the situations of the issues, what kind of Quan they considered and how they justified it.
