전후 서울의 전재복구계획 논의와 도시계획 추진 (Discussion of the Restoration Plan and the Promotion of Urban Planning in Seoul after the War)

초록

본 연구는 전쟁 이후 서울시의 전후 복구에 대한 논의 과정을 밝히고 전후복구계획안의 도시계획의 성격을 비판적으로 검토한 것이다.
서울시는 두 차례의 수복 과정에서 복구 계획에 대한 논의를 ‘준비론’으로 일관하다가 ‘서울도시계획개요안’에서 전재 복구와 구획정리사업을 동시에 시행할 것을 결정한 후 <내무부고시 제23호>으로 이에 대한 법적 근거를 마련하였다. 이후 제1,2중앙토지구획정리지구를 지정해 구획정리방식으로 전재지 정리 사업을 추진했다. 서울시는 전후복구와 도시계획을 명분으로 일제시기 국책 사업 시행을 위한 법적 근거로써 조선인의 소유권 및 토지에 관한 제반 권리를 박탈하는데 이용된 토지수용령의 단행을 밝힘으로써 강권을 통한 도시계획 추진을 예견했다.
인적‧물적 자원이 턱없이 부족하고, 구호물자 등의 물자 지원을 미국에 전적으로 의지하고 있는 상황에서 인구 300만 명을 예상한 도시계획 구상은 피난민들에게 사실상 복귀를 기대케 하는 위안밖에 되지 못하였다. 서울시는 시민들이 전재 복구를 위한 인적 자원으로 투입되기를 기대하며 시민들의 한시적인 복귀와 바라크 등의 임시 주택 건축을 허용했다. 그러나 정부 환도가 본격화되자 “생활 능력이 없는” 시민들의 복귀를 제지했고 ‘불법’ 주택에 대한 철거 명령을 내려 구획정리사업을 강행했다. 서울시는 가건축 양성화 정책과 처벌을 놓고 혼란을 야기하면서도 복귀 시민 증가에 따른 주택 문제는 강제 철거 외에는 뚜렷한 대책을 내놓지 못했다. 또한 일방적인 구획정리사업 추진으로 <귀속처리재산법>과의 충돌을 야기했으며, 환지 보상 문제 등 사회적 혼란에 대처하지 못했다.

영어초록

This study clarifies the process of discussing the post-war restoration of Seoul after the war and critically examines the nature of urban planning in the post-war restoration plan.
During the two restoration processes, the Seoul Metropolitan Government consistently discussed the restoration plan as a 'preparatory theory', then decided to carry out both the restoration of the war damage and the land readjustment project at the same time in the 'Seoul Urban Planning Outline', and issued <Notice No.23 of the Ministry of Home Affairs> to this effect. A legal basis for this has been established. Afterwards, the 1st and 2nd central land readjustment districts were designated, and the land readjustment project was promoted through the land readjustment method. The Seoul Metropolitan Government predicted the promotion of city planning through forceful authority by revealing the enforcement of the land expropriation ordinance used to deprive Koreans of ownership and all rights to land as a legal basis for the implementation of national projects during the Japanese colonial period under the pretext of post-war restoration and urban planning.
In a situation where human and material resources were sorely lacking and relied entirely on aid from the United States for material support, such as relief, the city planning plan for a population of 3 million was virtually nothing but a comfort and expectation for the return of refugees. The city of Seoul expected citizens to invest human resources for disaster recovery and allowed temporary return and the construction of temporary housing such as barracks. However, when the government returned to the country in earnest, it stopped the return of citizens who were “incapable of living” and placed them in “illegal” housing. A demolition order was issued and the land readjustment project was carried out. While the city of Seoul caused confusion over the policy and punishment for fostering temporary construction, it failed to come up with any clear measures other than forcible demolition of the housing problem caused by the increase in returning citizens. In addition, the unilateral promotion of the land readjustment project caused a conflict with the <Act on Disposal of Property Devolving upon the State> and failed to cope with social confusion such as replotting compensation.
