본 연구는 이혼재판절차에서 부모교육이 이혼부모의 역할에 대한 인식과 이혼분쟁조정에 영향을 미치는지를 알아보았다. 연구의 대상은 서울가정법원 이혼재판절차에서 가사조사를 받기 위해 온 부부들 중 민법상 미성년자의 자녀가 있고, 면접에 응하겠다는 부부 60쌍(총 120명)이다. 재판기록에 나타난 부부의 나이, 학력, 법적인 사물관할, 반소여부를 동일 수준으로 하여 각 20쌍씩 통제집단, 실험집단1, 실험집단2로 나뉘었다. 실험집단1에게는 이혼부모의 역할에 대한 팜플렛과 비디오를 보여주었고, 실험집단2에게는 팜플렛과 비디오를 보여주고, 연구자의 내용설명이 있었으며, 통제집단에게는 어떠한 처치도 하지 않았다. 본 연구에서 밝혀진 결과를 요약하면 다음과 같다.
첫째, 이혼하려는 부모의 자녀양육태도, 부모갈등으로부터 자녀를 보호하는 방법에 대한 인식, 이혼하려는 부모와 자녀관계에 대한 인식, 자녀의 이혼적응에 관한 관심정도, 이혼 후 공동양육관계에 대한 인식에 대해서 두 실험집단 모두 인식증진에 효과가 있었고, 실험집단1보다 실험집단2에서 인식증진에 더 효과가 있었다. 둘째, 이혼재판절차 중 이혼문제를 원만하게 해결하는 조정의 효과가 실험집단2에서 있었다. 특히 자녀의 양육에 관한 조정의 효과에서 실험집단2는 양육권, 양육비, 면접교섭에서 모두 조정의 효과가 있었으나 실험집단 1은 양육권, 면접교섭권에서는 조정효과가 없었고, 양육비에서만 조정의 효과가 있었다.

영어 초록

The present study purposed to examine the effects of parent education applied to couples in divorce procedure on their awareness of divorcing parent roles and divorce dispute mediation. The subjects of this study were 60 couples who visited the Seoul Family Court to receive family affair investigation in divorce procedure, had minor children according to the Civil Law, and agreed to be interviewed. The subjects were divided into a control group, experimental group 1 and experimental group 2(20 couples for each group) through frequency distribution matching according to age, academic qualification, legal material jurisdiction and whether to counterclaim reported on court documents. Experimental group 1 was shown pamphlets and videos about divorcing parent roles, experimental group 2 was shown pamphlets and videos and given detailed explanation on the contents by the researcher, and the control group was not given any parent education. The results of this research are summarized as follows.
First, as for the effects of the parent education programs on divorcing parents' awareness of divorcing parents’ child rearing attitude, the method of protecting children from parent conflicts, relationship between divorcing parents and children, interest in children’s adjustment to the parents’ divorce and joint child rearing after divorce, both of the two experimental groups showed improvement but experimental group 1 showed higher improvement than experimental group 2.
Second, experimental group 2 was different from the control group in the method of solving divorcing problems in divorce procedure. Experimental group 2 tended to want peaceful mediation of divorce. Particularly concerning mediation effect in negotiating for child rearing, experiment group 2 showed mediation effect in negotiating for child custody, child rearing expenses and the right to interview children but experiment group 1 showed mediation effect in negotiating for child rearing expenses but not for child custody and the right to interview children.
