What is a crime?
Some crimes are malum in se such as murder and rape
Many crimes involve acts of violence
Some crimes may not be morally wrong or violent and often infringe in the idea that crimes should involve another party. Whether the criminalization of these norms is acceptable is the purview of the legislature and always a current issue of debate
Edwin h Sullivan coined the term white collar crime in the 930’s
Terms in criminal law
Misdemeanors: fine or imprisonment for less than a year. Commenced when government file a charge called an information
Felonies: fine or imprisonment for more than a year. Commenced by grand jury indictment
Concepts in criminal law
Intent: most crimes require that the defendant willfully or knowingly committed them
Thus prior negligent liability in the same matter is not basis for an immediate criminal finding of guilt
However, a prior criminal finding of guilt can be the basis for future negligent claims
State offences: public prosecutors, such as district attorneys bring actions
Federal offences: the United States government brings actions directly in its own name
