영어 초록
On June 27, 2005, the Supreme Court held that one who distributes a device with the object of promoting its use to infringe copyright, as shown by clear expression or other affirmative steps taken to foster infringement, is liable for the resulting acts of infringement by third parties. While there have been some cases on the decentralized peer to peer (P2P) file sharing decided by a lower court and a court of other countries, the Grokster case will have much impact on the issue of file sharing across the world. The Court adopted new theory, i.e., the inducement rule, holding that one who distributes a device with the object of promoting its use to infringe copyright, as shown by clear expression or other affirmative steps taken to foster infringement, is liable for the resulting acts of infringement by third parties. It is unclear the Court limits the Sony case doctrine, staple article of commerce doctrine. This Paper concludes that while the Court indicates three features to decide the evidence of intent, the inducement theory would potentially threaten the technological innovation.
