철학을 하는 사람도 지금 이 시대를 살아가야 하는 사람이라면, 진지하게 현실 속에서 살아가는 사람들의 당면한 문제에 대해 고민해야 한다. 중국고대 춘추전국시대에 이와 같은 고민을 한 사람들이 있었는데, 그중 한비자와 순자를 들어, 그들이 당대의 문제에 어떻게 대응했는지 알아보고, 그 정신을 살펴 보고자한다. 한비자는 '철학이든 사상이든 현실과 괴리된 논의는 공론(空論)에 불과하다'고 말한다. 한비자의 생각과 유사한 주장을 하는 몇 사상가들이 있지만, 전국시대의 순자가 그러한 사람이다. 순자는 한비자의 스승으로 알려져 있는 인물이지만, 한비자와는 결이 전혀 다른 인물로 종종 알려져 왔다. 그러나 순자와 한비자 사상의 가장 큰 기본 가운데 하나는 "시대에 맞는 사상을 펼쳐야 한다." 는 것이다. 이런 생각은 파격이었다. 유가로부터 묵가, 심지어 도가에 이르기까지 고대 성현의 품으로 돌아가 그들의 가르침이 어느 시대나 통용되는 항구불변의 진리임을 거부했다. 이러한 순자와 한비자의 철학은 전국시대라는 전란의 시대에 대해, 또 인간에 대해 자세히 관찰한 결과에서 나온 것이다.
인간의 욕망을 선과 악의 도덕적 기준으로 설정한 사상을 단호히 거부하며, 인간 그 자체를 살필 것을 주장한 것이다. 한비자와 순자는 인간의 욕망을 인정하고, 욕망을 충족시킬 방안을 찾아야 한다고 보았다. 한비자의 핵심주장은 보편적 인간의 욕망을 충족시키기 위해, 법(法)이라는 기구를 이용하자고 말한다. 복잡다단한 권력의 구조를 읽어내고, 권력에서 불편부당하게 치우치지 않도록 술(術)과 세(勢)를 주장한다. 한비자가 주장한 핵심이 "당대 세상에 맞게 대책을 강구해야 한다."고 한다면 순자 역시 동일하다. 비록 한비자와 달리 순자는 강경한 목소리를 내지는 않았지만, 법이 엄격히 집행되어야 한다고 주장한다. 뿐만 아니라 성현의 말씀 역시 끊임없이 변화해야 한다고 주장한다. 한 걸음 더 나아가 누구든지 성현이 될 수 있다고 주장함으로서 인간의 발전 가능성에 대해 누구보다도 강조한다.

영어 초록

Given their living in this day, the philosophers also have to
seriously struggle with problems with which they always face in
daily life. Such ones were there in the Spring and Autumn and
the Warring States period of the ancient China. Two of them,
Hsün tzu. and Han-fēizǐ they are the philosophers who are
focused on in this paper; 'What was the way that they were
struggling with their daily problems?' Hanfeizi said, "It's a mere
impractical theory that either philosophies or thoughts are
discussed without the touch of reality." There were some
philosophers such as him, but we may regard Hsün tzu. as an
important one among them. Actually he was the teacher of
Han-fēizǐ but on the other hand they often have been found
thinkers who had thought so differently each other. One of the
frameworks of their thoughts, however, is to advocate "the
philosophy corresponding with its days." So exceptional it was in
that day. The juchia, Moism and even Taoism, they usually
thought of the teaching of the sages as the fundamental of their
philosophies. However, Hsün tzu. and Hanfeizi was different.
They were negative to the teaching of the sages. It was by no
means the everlasting truth corresponding with any days. The soil
of trees like their philosophies is consisted of struggles with the
agony of Warring States period and close researches on human
being. They rejected the thoughts that had set the desire of
people for the moral standard about good and evil, and
advocated to consider the human in itself. That is, Hanfeizi and
Hsün tzu. thought that the desire of human is inevitable and it is
necessary to find way how to fill it up. The way, according to
Hanfeizi's core theory, is to utilize the law. He emphasizes "the
shu (administrative techniques or statecraft)" and "the
shi(authority)" for deliberating the construction of power, and
preventing the authority from being partial. In the meantime, "the
political measure corresponding with its days", it is the same for
Hsün tzu.. Although he was a little gentle unlike Han-fēizǐ he
also insisted on administering the law strictly. Also he said that
the teaching of the sages should be renewed endlessly.
Moreover, he emphasized the possibility of human being more
than anyone else, advocating whoever could be a sage.
