1953년 7월 27일 6.25전쟁 정전협정 체결 이후 한국에서는 북방한계선 이남의 휴전수역(休戰水域)을 영해의 일부로 간주해왔다는 점을 들어서 이 선을 “부동의 영토선”으로 보는 관점이 지
배적이었다. 그러나 정전협정 체결 당시 육상과 달리 해상의 군사분계선(MDL: Military
Demarcation Line)은 협정문에 첨부된 지도에 명기되지 않았고, 이를 근거로 현재 한반도 서해의
북방한계선(NLL: Northern Limit Line)은 국제연합군 및 한국군이 일방적으로 선포한 선에 불과
할 뿐 정전협정이나 휴전체제와는 무관한 선이라는 주장도 제기되어 왔다. 이 연구는 이 대치선
의 의미를 제1차 세계대전 이후 동북아시아에 적용된 전후(戰後) 공간재획정 원리들의 연속성 상
에서 재조명한다. 그리고 정전협정 원문, 국제연합문서, 관련 지도들, 그리고 휴전회담록 등의 역
사적 근거들을 기초해서 이 대치선이 휴전회담 당시 “최상(最上)의 비무장지대”라고 언급되었던
해면(waters)을 사이에 두고 형성된 해상휴전선임을 논증한다.
영어 초록
As the map attached to the Korean Armistice Agreement, signed on 27 July 1953, had no line drawnin the Yellow Sea, some have insisted that there is no agreed-upon MDL(Military Demarcation Line)
in the Yellow Sea, and that the so-called Northern Limit Line was unilaterally declared by the
Commander-in-Chief, United Nations Command. While others are convinced that the line is an
inalienable territorial border. With these two arguments in mind and based on some newly discovered
maps related to this question and the records of the Korean armistice talks from 1951 to 1953, this article
reinterprets the NLL in the Yellow Sea as a maritime component of the Korean MDL, which was shaped
by the Korean armistice talks. In these talks, the “waters” between the islands under the control of the
U.N. forces and the coastal line under the control of the Communist forces was mentioned as “the best
demilitarized zone.”
