Ⅰ. Introduction
Since early times, human beings have always made a living by entering into a contract with others. These days, with the development of the society, a great number of contracts are being made and the contents of contracts are also getting more complex and various. Considering the importance of contract which becomes larger and larger, we need to take more interest in the contract law and go deep into the study of it. Therefore a study of `offer and acceptance` which form the vital elements of a contract, will be a very useful step to understand the contract law more.
In this paper, the present writer will focus on the comparison of the rules relating to offer and acceptance in English law with the rules on the topic in Korean law. This comparative study will be helpful to comprehend not only English law which belongs to the other legal system i.e. `Common law` (whereas Korean law belongs to `Civil law`) but also the formation of a contract in general.
