한국어 초록

형사사법제도란 전문적인 국가사법기관의 조직과 그 기능을 말한다. 일반적으로 경찰, 검찰, 법원 및 형사소송의 최종 과정인 교정기관에서 형사사법 법규들을 집행하는 조직과 제도를 총칭한다. 본 논문에서는 중국의 교정제도를 비롯한 형사사법제도의 특징 등을 연구하여 봄으로써 한국과 중국의 교정시설에서 서로가 나날이 증가하고 있는 수용자 문제와 한⋅중 양 국가의 범죄문제 공조체제에 이바지 하고자 하는 것이 본 논문의 주된 목적이다. 중국 형사사법제도에 있어서의 각 제도의 특징을 살펴보면, 경찰제도는 중앙경찰 기구인 공안부가 수사권의 전속성, 출입국 및 미결수용자 관리를 담당하는 등 막강한 권한행사를 갖고 있다는 것이다. 검찰제도는 검찰이 행정부와 평행의 독립된 헌법기관이며 민주집중제식의 검찰위원회가 있다는 점, 법원제도에 있어서는 2심제 재판체제⋅인민배심원제도⋅재판위원회제도가 있다는 것이다. 교정제도는 미결수용자 관리나 단기수용자(잔여형기 1년 미만) 관리는 공안부 담당이며, 사형집행은 법원이 담당하고, 교도작업의 생산성이 높다는 점이 주요 특이한 사항이라 하겠다. 그러나 중국의 모든 형사사법기관은 중국 공산당의 지시에 절대 복종해야 하며 공산당의 절대지도 아래에 있어야 한다는 태생적 한계가 있다는 것이 현재 중국 형사사법제도의 문제점이라는 것은 이론의 여지가 없을 것이다.

영어 초록

Criminal justice system refers to organizational structure and functionality of nation's specialized judicial branch. Generally speaking the organizational structure and functionality of the police, the prosecution, the courts, and the correctional system which is the final step of the criminal procedure are included in the criminal justice system. By analyzing special features of Chinese criminal justice system as well as its correctional system, this research mainly purports to contribute on the bilateral cooperative relation between Korea and China for the nations’ crisis in inmate situation and crisis in crime which has been continually increasing. The characteristics of each branch in Chinese criminal justice system can be summarized as follows: i) For the police branch, the Public Security Bureau (China’s central police agency) exercises dominant power over various areas such as having the exclusive authority to investigate most criminal offenses and carrying out responsibilities for the border control and pretrial inmates. ii) For the prosecution sector, the prosecution, entitled the Prosecutorate, is the entity constitutionally independent from the executive branch, and the Prosecutorial Committee, which is in accordance with the principle centralism, exists and oversees various issues for the prosecution. iii) For the court system, each case shall have at most two trials, and the courts may provide “People’s jury” trials and are regulated by the judicial committee (also known as the adjudication committee). iv) For the correctional system, the Public Security Bureau is in charge of administering pretrial detainees and short-term inmates (inmates serving less than one year in prisons); the courts are responsible for the execution of death row inmates; and the productivity of prison labor exhibits the high level of efficiency. However it cannot be disputed that the absolute control of the Communist Party of China over the entire Chinese criminal justice branch operates as the fundamental limitation for the criminal justice system in China.
