한국어 초록
개인정보 유출은 이미 세계적으로 민감한 문제로 취급되고 있으며, OECD나 EU 등 국제기구에서도 개인정보 관련 가이드라인이나 지침을 제정하고 계속 발전시키고 있으며, 미국, 영국, 호주
등 금융산업이 발달한 국가들도 적극적으로 개인정보 특히 신용정보의 관리강화를 위한 제도개선
을 추진하고 있다.
외국에서는 신용정보와 개인정보를 대부분 구별하지 않고 있으며, 대표적인 입법례로는 OECD
Privacy Guidelines, EU Data Protection Directive, 미국의 The Gramm-Leach-Bliley Act, Fair
Credit Reporting Act, 영국의 The Data Protection Act, The Consumer Credit Act, Data Security
in Financial Services, 호주의 Privacy Act, 일본의 개인정보보호법, 금융분야의 개인정보보호에 관
한 가이드라인 등을 들 수 있다.
IT의 발전에 따라 금융분야에서의 비즈니스 모델의 다변화, 융합화 현상은 어느 국가에서나 동
일하게 진행되고 있고 신용정보에 대한 입법도 금융IT감독의 체계나 내용 등 일부를 제외하면,
OECD 가이드라인의 기본원칙을 반영하여 상당부분 유사하게 구성되어 있다.
우리나라의 경우 개인정보보호법, 신용정보법 등 법제도적인 측면에서도 OECD의 개인정보 기
본원칙 수용을 비롯한 정보통신에 관한 법제의 신속한 마련 등으로 대체로 다른 국가에 비해 오히
려 앞서고 있는 것으로 판단된다.
금융분야의 경우에는 국민의 재산상 피해로 직결된다는 점에서 보다 엄격한 규제가 허용되는 분야로 볼 수 있으며, 창의적인 정보의 가공을 통한 산업발전 보다는 안정적이고 안전한 사용이
우선하여 요청되는 분야로 판단된다.
개인정보에 대해서 우리나라는 법제도적인 미비가 있어서 다수의 정보유출 사고가 발생하는 것
으로 보기는 어렵다. 오히려 현행법의 준수와 엄격한 집행, 위반시 강한 제재가 필요한 시기라 생
각된다.
영어 초록
Personal information leakage has become a sensitive issue around the world. Internationalorganizations such as OECD and EU have established and have been developing Privacy
Guidelines and Privacy Directives, while countries with sophisticated financial industry, such as
the US, UK, and Australia, are reinforcing protection and management system of personal
information, especially of credit information.
In overseas, there is no legal distinction between credit information and personal
information. For example, there are the OECD Privacy Guidelines, the EU Data Protection
Directive, the Gramm-Leach-Bliley Act and Fair Credit Reporting Act of the US, the Data
Protection Act, the Consumer Credit Act, and Data Security in Financial Services of England,
the Privacy Act of Australia, and the Data Protection Act of Japan.
With development of information technology, the phenomenon of diversification and
convergence of business models in financial industry is taking place in every country. A
significant portion of laws on credit information is similarly composed, reflecting the basic
principles of to the OECD Guideline.
In case of Korea, its strength in IT is evident in financial area. Privacy laws of Korea is well
established based on the basic principles of the OECD guideline. Korea quickly adopted credit
information protection systems and strong oversight systems, which makes it one of the most
developed countries in the area of data information and communication law.
Financial industry requires strong oversight because financial accident may result in
widespread property damage. Therefore, reliable and safe use of personal information should
take priority over development of industry based on creative information processing. At the same time, adherence to and strict enforcement of existing laws, and strong sanctions for
violation is necessary.
