Korean Constitution defines that every people should be given freedom of the press, publication, assembly, and association in Article 20 Clause 1. And by Article 20 Clause 2 of the Constitution, press, publication should not infringe honor and right of others. The constitution put the limit to restrict freedom of the press. In this case, Bea Bu-Jeon, a reporter of Korean newspaper in New York, made Beak Ji-Yeon, a famous woman reporter, reported on the newspaper without her permission. Mr. Bea insisted that Ms. Beak`s child not be her son on the newspaper. One of Korean sports newspaper carried Mr. Bea`s opinion on the newspaper without any evidence. Ms. Bea won the trial against the one of the Korean sports newspaper as well. We think these two cases are significant because they not only set up the standard in the defamation in the cyberspace but also defended Ms. Beak and her son`s dignity. We think that these cases will reduce the number of the defamation in the cyberspace and the invasion of privacy about famous women and entertainers. And, we hope these cases will be the opportunity of taking personal right and protection of privacy into consideration in our society.
