본 연구는 민주주의의 성숙과정에서 나타나는 법 동원화(legal mobilization)의 증가, 혹은 사법 의존성에 주목하면서 법원이 정치과정의 중요한 일부를 차지하는 정치적인 제도로 인식되어야 한다는 점을 강조한다. 오늘날 민주주의 사회에서 흔히 발견되는 이러한 사법 의존성의 증가는 시민사회의 권리 의식의 함양, 그리고 법치주의의 제도화를 근간으로 한 자연스러운 변화로서 선거에 의한 정치 이외의 ‘다른 수단의 정치(politics by other means)'로서 중요한 정치제도의 기능을 수행하는 것으로 이해될 수 있다.고용 성차별 이슈를 중심으로 법원의 정치제도적 기능을 분석한 연구의 결과는 민주화 이후에 다양한 고용상 성 차별의 문제로 인해 발생한 갈등을 법원의 판결을 통해 해결하려는 시도가 지속적으로 있었으며, 실제 판결의 결과 역시 점진적으로 입법의 취지를 현실화하는 방향으로 전개되어 왔음을 보여 주었다. 법조인을 대상으로 한 서면 면담 자료에서도 법원의 정치제도로서의 기능에 대해서는 대부분 인정하고 있음을 알 수 있었으며, 법원은 어디까지나 다른 수단의 정치로서 정당화의 수단을 제공하는 범주에서 기능해야 한다는 데에 인식을 공유하면서 사법우월주의, 혹은 법치주의와 민주주의의 갈등적 구도를 경계하는 것으로 나타났다.
이러한 연구 결과는 오늘날 민주주의 제도가 안정성을 찾아가는 단계에서 법원의 정치제도로서의 역할이 증대하는 것은 법원의 정치적 기능이 시민사회의 성숙, 민주적 권리의식의 증가를 반영하면서 부각된 현상으로 이해되어야 하며, 법원의 정치과정에서의 중요성에 좀 더 주목할 필요성이 있음을 시사하는 것이기도 하다.
영어 초록
This study argues that courts need to be recognized as political institutions in Korea according to the increasing legal mobilization and its growing importance in political processes. The recent expansion of legal dependencies in Korean society reflects growing right-mindness of citizens and institutionalization of procedural legal system. Courts are, nowadays, recognized as 'other means' of political participation.The case study showed that there have been growing numbers of legal sues regarding unequal employment and courts have gradually contributed for implanting the Equal Employment Opportunity Law by resolving those conflicts based on legal interpretation. The Experts' Survey Results showed that they recognized the importance of courts as political institutions and they agreed that the ideal function of courts as other means of politics should be within the boundary of offering legal justification, and should not exceed to invade in parliamentary decision-making functions. Although they shared the idea of courts as political institutions, they warned the dangers of conflictual structure between supremacy of jurisdiction and representative democracy in the time of growing legal dependencies.
