본 연구는현재 우리나라의아동권리협약의유보조항철회를위한 구체적과제를제시하고자거시적관점에서국내외협약 유보조항및 유보국가의특성을파악하고미시적
관점에서유보조항과관련법과의상충된 점을 살펴보았다. 본연구결과첫째, 아동의
면접교섭권관련 조항을 유보한 국가는우리나라가유일하며최근 관련법인민법개정
안이 국회를 통과하여유보철회를위한 법적 정비를마친 상태이다. 둘째, 입양허가제
와 관련되어서는신고절차에의한 일반입양제도와입양허가기관에대한 정의의문제로
많은 논란이 있을 뿐 구체적인유보철회방안이제시되지못하고 있는 상태이다. 따라
서 본 조항의취지에부합하도록관련법을정비하고, 입양허가기관에대한 정확한지정
이 필요하다. 셋째, 상소권과관련되어서는B규약과동일하게유보된조항으로본 조항
의 유보철회를위하여관련 법률을재해석하여야하며, B규약의유보철회와함께 유보
철회가이루어지도록적극적조치가필요하다.

This study examined the practice of the states parties to the Convention on the Rightsof the Child(CRC) regarding reservations and the Korean internal legislation, which was
incompatible with reservations to articles 9, para 3, 21 para (a) and 40 para 2(b) and
(v).
The results of this study were as follows: 1) Many states have made reservations
concerning article 14 'freedom of thought, conscience and religion' and religious belief
or national constitution and laws. 2) Lately the revised bill on the Civil ACT containing
'the child's right to maintain contact with both parents which seemed to approach to the
9(3) of the convention, passed to the National Assembly. 3) CRC points out that adoption
of a child is should be authorized only by competent authorities. Regarding the issues,
a legal report and definition of 'competent authorities' are still in debate in Korea. 4)
Although article 14(5) of International Convention on Civil and Political Rights that
is similar to 40(2)(b)(v) of CRC is reserved by Korean Government, reassesment of
the decision has not initiated.
This study suggested that Government policy and research of child's rights includes
withdrawal of reservations and government must supply the measure to promote full
implementation of CRC.
