한국어 초록

교정제도란 협의의 의미로는 비행소년이나 범죄인의 재사회화 목적에 관련된 일련의 법령이나 규칙 등을 뜻하며 광의의 의미로는 그 목적을 수행하고 있는 관련 조직의 기능까지도 포함하는 개념이라 할 것이다.
한 국가의 문화수준을 비롯한 그 국가의 수준은 그 국가의 교정제도 수준을 평가하여 보면 쉽게 판별할 수 있을 것이다. 그것은 어느 국가사회이든 간에 교정제도는 가장 인권의 사각지대이며, 저변의 상황에 처해져 있는 분야이기 때문이다. 한마디로 한 국가의 교정제도는 그 국가의 수준을 가늠하는 중요한 척도라고 하겠다.
현재 날로 늘어나고 있는 범죄문제 해결방안은 재범방지대책이 그 주요 방안이라고 할 수 있다. 이러한 재범방지대책은 교정제도의 사회적 역할과 그 기능이 제대로 수행 되어야 소기의 성과를 걷을 수 있을 것이다. 현재 날로 늘어가고 있는 교정수요의 증대를 효율적으로 수행하려면 타 국가의 교정제도 중 미래지향적인 제도들을 한국교정제도 운영에 취사선택 반영하여 한국교정의 개선방안을 제시해 볼 필요성이 있는 것이다.
이러한 전제하에 본 논문에서는 한국의 교정제도를 아시아･유럽･아메리카 등 각국의 교정제도와 비교･분석하여 보았다. 각국의 교정제도의 장단점을 분석함에 있어서 먼저 교정조직과 그 기능을 개괄적으로 검토하였으며 수용자의 교정처우 실태는 교정교육, 교도작업, 의료처우, 개방처우, 권리구제 등을 중점으로 하여 그 실태를 개괄적으로 논의하였다.
특히 우리 한국 교정제도의 모태라고 할 수 있는 일본의 교정제도를 비롯하여 미국과 중국의 교정제도를 중점적으로 심층 비교･분석하였다. 또한 U.N. 피구금자 처우에 관한 기준규칙 (U.N. Standard Minimum Rules for the Treatment of Prisoners)과 유럽형사시설규칙[2006] (The European Prison Rules [2006])을 한국의 교정제도 실태와 비교･평가하여 한국교정제도의 문제점과 발전방안을 제시하였다.

영어 초록

The correction system can be narrowly defined as a series of laws and regulations related to the purpose of re-socialization of juvenile delinquents or criminals. In a broad sense, however, the correction system is a concept that includes the function of the related organizations carrying out the purpose of re-socialization.
A country’s development level, such as cultural development level of that country, can easily be determined by assessing the level of the country's correctional system. This is because, no matter which country it is, the correctional system is the darkest blind spot on human rights and is the area remaining in a state of underdevelopment. In short, a country’s correction system is an important tool that can measure the developmental level of that country.
The measure for the prevention of the recidivism seems to be the most effective solution for the ever- increasing problem of crime faced today. Such measures for prevention of recidivism will be able to produced desired results only when the function and the role of the correctional system in a society are properly performed. In order to efficiently cope with the ever increasing demand for corrections, it is necessary to present future improvement plans for Korean correctional system by selectively choosing and applying correctional systems of other countries that are both future oriented and suitable for Korean system.
Based on this premise, this article compares and analyzes the correctional system of Korea with the correctional systems of various Asian, European, and American countries. When examining the strengths and weaknesses of each country’s correctional system, the correctional organization and its functions were first reviewed in an overview, and the actual condition of correctional treatment of the prisoners was generally discussed, focusing on correctional education, correctional work, medical treatment, open treatment, and redemption of rights.
Especially, the correction system of the United States and China as well as the correction system of Japan, which can be regarded as the origin of our Korean correction system, were analyzed in detail. In addition, the problems and development plans for the Korean correction system were suggested by comparing and evaluating U.N. Standard Minimum Rules for the Treatment of Prisoners and The European Prison Rules [2006] with the actual conditions of the Korean correction system.
