ABSTRACT

정보통신 등 첨단산업 분야에서 국내⋅외의 표 준화기구를 통하여 설정된 기술표준이 널리 활용 된다. 표준화에는 다양한 친경쟁적 효과가 있으나, 표준 설정 과정에 개입된 경쟁제한적 행위로 인하여 공정한 시장 경쟁이 저해될 우려도 있다. 표준화기구는 이를 방지하기 위하여 참여 사업자들에게 지적재산권 공개 의무나 FRAND 확약 의무를 부여하는 등 지적재산권 정책을 운영하고 있으나, 대체로 그 내용이 명확하지 않고 위반시에도 실효성 있는 분쟁해결수단이 없어 문제가 된다.
최근 표준화 과정을 왜곡하여 획득한 표준필수 특허 보유자의 특허권 남용행위에 대한 규제의 필요성이 높아지고 있다. 표준필수특허 보유자의 특허매복 행위나 특허위협 등 부당한 특허권 행사에 대하여는 계약법이나 특허법, 더 나아가 위와 같은 행위가 경쟁법적으로 문제가 될 소지가 있을 경우 공정거래법에 따른 규율이 가능하고, 이들은 중복될 수 있으며 서로 상호보완적 관계에 있다. 다만, 우리나라의 계약법 및 특허법은 그 규율 목적과 요건, 제한적 효과, 법원의 신중한 태도 등에 비추어 표준필수특허의 남용 행위에 대한 구제수단으로서 일정한 한계가 있는바, 공정거래법 집행 이 효과적인 대안이 될 수 있다. 우리나라는 아직 표준필수특허 남용행위에 대한 규제 경험이 많지 않아 공정거래법의 구체적인 적용법조나 적용범 위 등에 논란이 있고, 공정거래위원회가 부당한 지적재산권 행사를 규율하기 위하여 만든 심사지침 또한 공정거래법의 개별 규정과의 관계가 모호 할 뿐만 아니라 규제범위가 지나치게 광범위하다는 비판이 있다. 앞으로 공정거래법과 심사지침을 보다 명확하게 규정하고 당사자들의 예견가능성을 높이는 방향으로 개선해 나가야 할 것이다.

영어 초록

In the high-tech industries including Information and communication technology industries, Technical standards adopted by Standards-Setting Organizations (SSOs) are commonly used all over the world. Standard-Setting Enhances Competition, but it also presents Opportunities for Anticompetitive Conducts which potentially hinder fair competition in the relevant markets. SSOs have Intellectual property rights policies (IPR policies) containing disclosure rules of the patent information and licensing rules which requires FRAND commitments to their members of SSOs to prevent Anticompetitive harms, but They usually aren’t clear in the contents and have no effective remedies resolving disputes.
Nowadays antitrust enforcement efforts are required to the unfair exercise of the Standard essential patents (SEPs) which was obtained by biasing standard-setting process. For the abuse and unfair exercise of the SEPs which is known as Patent Ambush or Patent hold-up, we can apply the remedies under the civil law or patent law, and further if the conduct is likely to have any anticompetitive effect, antitrust enforcement is also available. The remedies can be overlapped to one case, and they are in complementary relationships. But there are limits of contract law and patent law in the aspects of regulation goals, requirements and effects, and judicial rulling of the courts. Therefore antitrust enforcement can be an effective alternative for the regulation on the abuse of the SEPs. There aren’t many antitrust enforcement cases in Korea that it can cause confusion which article of Monopoly Regulation and Fair Trade Act (MRFTA) should be applied or to which extents the regulation should be imposed. And The Review Guidelines on unfair exercise of Intellectual Property Rights by the Korea Fair Trade Commission (IPR Guidelines) also have problem that the specific types of conducts that listed in IPR guidelines are not matched with the requirements of the conducts regulated by the MRFTA and there is a risk of excessive enforcement of the law. Continuous improvement efforts to enhance the clarity and predictability of MRFTA and IPR Guidelines in regulating the abuse and unfair exercise of the SEPs are required.
