한국어 초록

파리 풍피두센터의 국립미술관(MNAM) 벽에는 페르냥 레제의 적색과 녹색의 옷을 엽은 여인
(Woman in Red and Green) 이라는 그림이 걸려져 있다. 이 그럼에는 다른그럼에서는 찾아볼
수 없는 ‘R2P'라는 기호가 표시되어 있는데 ， 여기서 ‘R’은 반환 (return. repatriation.
restitution)을 의미하며 ’2‘는 그럼이 미술관에 도착한 연대순을 의미하며 , ’p '는 그림 (painting)
을 의미한다 다시 말하자면， 이 그렴은 ‘2차세계대전 이후에 반환에 작품、이며， 나치에 의해 약탈
되었던 수천점의 프랑스 작품 중의 하나이며 ， ‘R2P' 라는 기호는 소유자확인불명의 작품이라는 사실
을 나타내어 주고 있다. 그렇다면， 과연 이러한 작품의 원소유자는 누구이며 ， 이동경위 ， 작품과 관
련된 소유권과 이를 증명할 수 있는 제반적인 법리， 당위성은 무엇인가.
문화재반환요구는 1960년도에 들어서면서부터 피식민지 국가와 제3세계국가들이 독립하는 과정에
서 의례히 제기되는 문화민족주의에 근저를 둔 하나의 사회문화적 ( socio-cultura1 phenomena) 현
상으로서 국제 사회에서 하나의 중요한 당면과제로 인식이 되기 시작하였다. 최근에만 해도 BC1200년께의 트로이 유물이 러시아에 은닉중인 곳이 밝혀지면서 독일과 터어키가 각기 소유권을 주
장하여 러시아를 상대로 하여 반환을 요구하고 니섰으며， 러시아와 독일은 2차세계대전 때 강뺨
간 허틀러가 소련에서 강탤H 간 예술품과 소련군이 독일에서 강탈해간 문화재로 신경전을 벌이고
있다. 대영박물관으로부터 옐진마블(Elgin Mrbles) 을 반환하려는 그리이스 정부의 노력은 벌써
50여년째 계속되고 있다.
혹자들은 문화재반환을 둘러싼 국가간의 안력을 “제3차세계대전 (the Third World War)" 혹
은 “문화전쟁 (Culture War)'’이라고 일걷고 있으며， 인류학자인 Keith Nicklin(1979)는 이러한
문화재 약탈행위를 영어의 ’rape( 약탈 혹은 강탈)’라는 단어를 사용하여 설명하였고， Kif1e
Jote (1 994) 는 ’한 나라의 문화재에 대한 일련의 약탈행위가 한 민족의 갱신적이고 물질적인 문화
유산에 대해 영원히 회복시킬 수 없는 손실을 입혔으며 ， 문화재의 반환에 대해 적극적이며 진솔한
태도가 결여된 것은 아직도 이러한 문화제국주의가 현재까지도 살아숨쉬기 때문"이라고 역설하였
다.

영어 초록

The purpose of this study is to address the issue of the repatriation of cultural
property within the context of relevant historic외 and contemporary issues. Some
fundamental questions in the debate over cultural property are: How do different
cultures define the term ’ cultural property’?: Should cultural heritage be repatriated?:
Who has the rightful ownership and/ or responsibility to preserve cultural properties
of past?: and What values and criteria have been used in the setting of disputes?
For a theoretical foundation , the nature of artifacts as culturally embedded
object is examined philosophically , politically and within an historical context.
Then the dichotomy of cultural nationalism and cultural internationalism is
presented in order to delineate values and arguments , thereby providing values
and priorities for a reasonable and workable paradigm by which to treat the issue.
The strategies used to address the issues of repatriation are the definitional
testO .e., the definition of cultural property through the content analysis) and case
studies{a review of precedent records of repatriation).
The content analysis reveals some obstacles to consensus in repatriation
because the definitions of cultural property are neither consistent nor uniform in
spite of being similar in their purpose and content. The case studies also unveil
some aspects of conf1ict in the issue of repatriation such as the legal dimensions of domestic and international remedies for the equitable settling of disputes.
I conclude that. despite the fact that most nations are actively trying to protect
their cultural heritage , it is clear that there are still no absolute values , no
uniform definition on c비tural property, and no systematic principles in dealing
with the issues of repatriation of cultural property. However, as a beginning, in
my view, identifying the function , nature and significance of objects and the
means of their removal is an imperative strategy for resolving disputes over title.
In this , the dignity of all parties involved should be preserved , while describing
the dynamic exchange of views on repatriation. It is my hope that such a strategy
may lead a greater cooperation between nations in securing just and fair outcomes
through ensuring benefits to all.
