1. Issue
The plaintiff Porsche is world famous automobile company. Porsche was founded in 1931 by Ferdinand Porsche. The defendant David Spencer is the owner of numerous Internet domain names.
On December 6, 1999, defendant registered the domain name PORSCHESOURCE.COM and offered automobile manufacture for sale. When Plaintiff visited website “PORSCHESOURCE.COM”, plaintiff found the following word: “domain for sale”. So plaintiffs filed suit against defendant about cybersquatting. And plaintiff seek a preliminary injunction to defendant to prevent selling or transferring or using the Internet domain name “PORSCHESOURCE.COM”. Also plaintiff requests that the Court order Defendant to transfer the domain name “PORSCHESOURCE.COM” to Porsche.

The court held that plaintiffs established a strong likelihood of success on its ACPA claim. Although the two claims[15 U. S. C. § 1125(d)(1)(B)(ⅰ)(Ⅴ) and (Ⅶ)] in favor of the defendant, but majority of the factors in favor of the Plaintiff. Therefore Defendant likely acted with a bad faith intent to profit from Porsche's mark. The court preliminarily enjoined defendant from "auctioning, offering for sale, transferring and/or using in any way" the domain name "porschesource.com," and ordered defendant to deactivate his website within six weeks.
