In this essay, I will critically discuss the impact of the Human Rights Act 1998 (HRA) and Articles 2, 3 and 8 from the European Convention on Human Rights (ECHR) on access to the public healthcare treatment in the UK.
Firstly, I will explore the enforcement of the rights listed in the ECHR (Convention rights) and the HRA in the British jurisprudence. Secondly, I will critically analyse the meaningful cases where Articles 2, 3, 8 of the Convention rights and the HRA played a vital role in acknowledging the importance of access to treatment particularly for social minorities, such as patients with mental illness, transgender people and non-national aliens on the verge of deportation. I will then describe a wider implication of the judicial approaches observed in such cases and how it may assist patients when access to treatment is denied by the British public healthcare authorities.
