Introduction
A : "Romance to me, Adultery to others". Have you ever heard this phrase? Many Korean dramas use adultery as a subject and people show great interest to it. According to the statistics in 한겨레 newspaper, the portion of Korean drama concerned with adultery is 58.3%.
The adultery law is the one of the many old controversial issues. Many people went to Constitutional Court to decide whether the adultery law must be maintained or abolished and whether it is constitutional or unconstitutional. In 1990, 1993, 2001, 2008, issues whether the punishment of adultery is constitutional or unconstitutional was raised but it was always determined to maintain.
Now, let`s look into adultery. According to the Korea Constitution, section 1, article 241, the meaning of adultery is the crime that someone who is married has sexual intercourse with a person who is not his or her spouse. So just kiss or hug is not enough to be counted as adultery. According to Article 241, Section 1 of the Korea Constitution, someone who commit adultery must serve less than two years in prison.
