초록

이 논문은 조선시대 관제 해명의 일환으로, 상설관서에 집중되어 있었던 연구사적 한계를 극복하고, 상설관서만큼 중요했던 임시관서에 대한 해명의 일환으로 서술하였다. 특히 조선시대 도감제에 관한 성과가 많지 않은 가운데, 도감이 가장 활발히 활동했던 선조대 임진왜란기의 도감 설치와 운영을 살펴, 도감제가 조선사회에서 차지하는 위상을 검토하고, 조선에 도감과 같은 임시관서가 필요했던 이유에 대해 밝히고자 하였다. 이는 궁극적으로 도감제의 역사적 의의를 재고하는데 도움이 될 것으로 판단한다.
Ⅱ장에서는 선조대 도감의 설치와 운영을 임진왜란이 종결되는 1600년 9월을 기점으로 양분하여 살펴보았다. 전쟁 시기인 임진왜란 시점에 도감의 운영은 모두 전시에 특화된 기능을 하였다. 이 시기 설치된 도감은 시대적 상황을 반영한 운영을 하였는데 그 사무는 바로 전시 상황을 수습하기 위한 사무였다. 이어 1600년 9월부터 선조가 승하한 1608년 2월까지의 도감의 설치와 운영을 살폈다. 이 시기 설치된 도감은 총 15종으로, 이들 도감은 앞선 시기의 도감과는 달리 전시와 유관하면서도 평시체제에 어울릴만한 도감의 설치가 눈에 띤다. 이처럼 임진왜란과 그 이후 설치된 도감을 통해 전시체제 官制에 관한 일말의 단서를 얻을 수 있다.
Ⅲ장에서는 바로 이러한 점에 초점을 맞추어 임진왜란기 도감의 설치배경과 역할을 살폈다. 그리고 도감제가 다양한 폐단이 있음에도 불구하고 존속할 수 있었던 이유를 검토하였다. 조선시대 도감이 존속할 수 있었던 것은, 기본적으로 당대의 필요에 의해 유지될 수 있었다. 이 시기 도감 설치의 주요 배경은 임진왜란이라고 하는 전시상황이었다. 도감은 이러한 전시 상황에 맞는 역할을 하였다. 앞서 살폈듯이 전시외교라든지 실제 군사훈련이라든지 민생 문제와 같이 중요한 정책적 과제를 시행하기 위해 도감을 설치하고 이를 활용하여 문제를 해결하였던 것이다. 이러한 도감의 시의적절한 활용은 도감이 제도로서 존재할 수밖에 없는 필연성을 알려준다.
물론 이 과정에서 관원의 사적 유용이나 별도로 수취한 재원으로 민생이 곤궁해졌던 폐단이 있었음은 부인할 수 없다. 더욱이 이 시기 빈번히 설치된 도감은 조선의 ‘設官分職’의 원리를 파탄에 빠뜨려, 조선의 관제가 문란하게 될 여지도 제공하였다. 그럼에도 이 당시 도감이 없어서는 안 될 중요한 역할을 수행하였음은 부인할 수 없다. 도감은 ‘1품아문의 정치적 위상을 지닌 행정관서’였고, 이에 따라 기존 상설관서가 처리할 수 없는 중대한 사안에 전문가를 효율적으로 배치, 인력과 재원을 집중할 수 있었다. 즉, 조선은 임진왜란이라고 하는 희대의 국가적 위기를 타개하는 한 방도로서 ‘권설관서’라고 하는 제도적 장치를 적극 활용하여 극복할 수 있었던 것이다. 그리고 바로 그 점이, 도감제가 존속할 수밖에 없는 결정적인 원인이 되었을 것으로 판단된다.

This paper is to explain as a part of the elucidation of the politicalinstitution(官制) of the Joseon Dynasty, and to overcome the limitationsto the research of history that has been concentrated on the permanentoffices(常設官署) as well as important temporary offices(臨時官署). Whilethere had not been many achievements on Dogam system(都監制) of theJoseon Dynasty, the study is to look at the Dogam(都監) establishmentand operation of a turbulent period of Dogam(都監) when it had beenmost active. And also it is to know why it was necessary temporary suchoffices, such as the Dogam(都監) in Joseon by considering a position thatDogam(都監) occupied the Joseon society. This is, ultimately determinesthat help to reconsider the historical significance of the Dogam system(都監制).
