‘비범죄화’ 관점에 선 간통죄 소추조건의 축소해석 (Reinterpreting Procedural Prerequisites for the Crime of Adultery to Limit Its Criminalization)

초록

간통죄가 간통을 억지한다는 주장은 이론적 정당성도 현실적합성도 의심스럽다.
또한 애초에 간통죄는 혼인 회복을 위한 조항으로 설계되어 있지 않다. 간통죄가 우회적․간접적으로 기존의 혼인을 지키는 기능을 할지도 모르나, 기존의 혼인을 해소하고 새로운 혼인을 추구하는 것을 형사제재의 위협으로 저지하는 심각한 문제를 야기한다. 국회는 헌법재판소는 다섯 번째 결정을 기다릴 것이 아니라 입법부로서의책무를 다해야 한다.
한편 간통죄가 사실상 파탄이 난 부부 사이에 복수수단으로서 기능하는 것을 막는 해석론도 필요하다. 판례의 기준인 “명시적 이혼의사의 합치”가 있는 경우는 물론 “묵시적 이혼의사의 합치”가 확인되는 경우에도 간통종용을 인정하고, 간통죄 고소 이후 협의이혼을 한 경우 간통죄 고소를 취소하지 않는다는 명시적 의사표시가없는 한 고소취소의 의사표시를 포함하고 있다고 해석할 필요가 있다. 그리고 스스로 부정행위를 한 배우자가 상대 배우자를 간통으로 고소하는 것은 고소권의 남용으로 보아야 한다. 또한 간통피해자가 사망하거나 금치산선고를 받은 경우 그 가족이간통고소권을 행사할 수 있게 한다면 간통죄가 부부 당사자를 넘어 양측 가족 전체의 복수 도구로 사용될 것이므로, 이 경우는 형면제사유로 파악하여 형벌권 발동을저지해야 한다.

영어초록

The crime of adultery is a good example of the moralist tradition in Koreancriminal law. According to the Korean Penal Code and the Korean Criminal ProcedureCode, the adulterer may be prosecuted only if his/her spouse makes complaints andthe accusation cannot be made until the marriage has been dissolved or a divorceaction has been filed. If a victimized spouse condones or forgives his/her adulterousspouse, complaint may be no longer valid.
Most Korean legal scholars argue today that adultery should not be criminalized,maintaining that adultery be a matter dealt with divorce law and not under criminallaw. The Korean Constitutional Court, however, has repeatedly confirmedconstitutionality of this controversial crime in its four decisions. It is noteworthy thatthe majority opinion of the Court in its 1990 decision offered a suggestion to thelegislature that it should survey the trends in the legal conscience of the public andseriously consider the arguments in favor of abolishing the crime of adultery.
Arguing for de-criminalization of adultery, this Article is also to criticize theSupreme Court's interpretation of the procedural prerequisites for the crime of adulteryand provide a new interpretation to limit the scope of the criminalization of adultery.
First, it argues, the "condonement" that nullifies the complaint of the spouse beassumed when there is an implicit agreement of divorce between the couple, forinstance, separation agreement, as well as a clear agreement of divorce between the couple, even though the Supreme Court has maintained only the clear agreement asthe prerequisite for the "condonement" in its 1991 decision. Second, it argues that avictimized spouse' complaint be null when divorce action is dropped for mutualagreement on divorce is made. Third, it argues that an adulterous spouse not beallowed to file a complaint against his/her adulterous spouse, for such a complaint isan “abuse of rights” which is prohibited by the Article 2(2) of the Korean Civil Code.
Fourth, it argues that when a victimized spouse is deceased, prosecution of anadulterous spouse be prevented by the complaint of the family member of the deceased spouse.
