대통령 배우자의 법적 지위 (The Legal Status of the President's Spouse)

초록

우리는 대통령의 배우자를 퍼스트레이디 또는 영부인, 여사(女史)라 부르고 있다. 대통령 배우자는 헌법을 비롯한 법률에 명확히 명시된 권한이나 책임, 요구되는 임무나 역할 등은 없다. 관행적으로 대통령의 해외순방에 동행하며, 국가 공식행사에 참석하고, 대통령을 대신하여 외교 사절로 활동하며, 외국 귀빈 방문이 있는 경우 접견 등 행사를 주최하기도 한다. 또한 대통령이 부득이 참석하지 못하는 국내행사에 참석하기도 하며, 대통령 배우자의 개인적 관심에 의해서 교육‧복지‧의료‧문화 등의 분야에서 다양한 대외 활동을 수행하며 대통령 직무를 직‧간접적으로 돕고 있다. 미국의 퍼스트레이디 제도는 선거에 의해 선출되지도, 임명되지도 않았지만, 공적인 업무를 수행하는 독특한 존재이다. 미국의 퍼스트레이디는 대통령 배우자의 내조 역할을 넘어 공공외교관의 역할까지 수행하고 있다. 미국 연방법(USC) 제3편 제105조는 “대통령의 의무와 책임을 수행하는 데 대통령의 배우자가 대통령을 지원하는 경우 대통령에게 부여되는 지원 및 서비스가 대통령의 배우자에게도 부여된다. 대통령이 배우자가 없는 경우에는 이러한 보조 및 서비스는 대통령이 지정하는 가족에게 제공된다.” 규정하고 있다. 미국 연방법은 대통령 배우자의 공적 역할을 지원하는 법적 근거를 명확히 하고 있고, 모든 공적 활동이 법적인 테두리 안에서 이루어지고 있다는 점에서 우리와는 대조적이다. 우리나라의 대통령 배우자는「대통령 등의 경호에 관한 법률」에 의하여 대통령 경호처의 경호 등 공적 지원을 받는 공인(Public figure)이다. 대통령 배우자는 국민으로부터 직접 선출되지 않았음에도 사실상 공적 활동을 하고 있다. 대통령의 배우자는 대통령에 대한 제1의 조언자이며 지근거리 정책결정자(proximate policy maker)로서 비공식적으로 대통령의 정책형성과 최종 의사결정에 중요한 역할을 수행하며, 대통령직(職) 수행과정에서 직‧간접적으로 절대적인 영향력을 미치고 있음을 부인하기 어렵다. 오늘날 대통령 배우자의 활동이 더욱 중요시 되고, 그 공적인 활동 범위가 확장되고 있다. 이러함에도 우리에게는 대통령 배우자의 활동 범위를 규정하거나 인적‧물적 지원에 대한 명시적인 법적 근거가 없다. 대통령의 배우자인 퍼스트레이디의 역할과 책임, 예산 지원 등을 명확히 규정하는 것이 법치주의 원리에 부합한다. 국정 운영의 투명성 확보와 책임행정의 구현을 위해서도 대통령 배우자의 법적 지위를 법률에 명확히 규정할 필요가 있다.

영어초록

We refer to the President's spouse as the First Lady or President's Lady. The legal status of the President's spouse is not authorized by constitutional or statutory law, nor is it an elected position. It is a position earned by virtue of being married to the President. Defining the role or duties of the First Lady, the President's spouse, is very difficult as there is no legal basis for her responsibilities, unlike those of the President. The term of office of the President's spouse is the same as that of the President. Although there are no clearly defined powers, duties, roles, or responsibilities in the Constitution or other laws, the First Lady usually accompanies the President on foreign tours, attends official state events, acts as a diplomatic envoy on behalf of the President, and hosts events such as receptions for foreign guests. She may also attend domestic events that the President is unable to attend. In addition, depending on the personal interests of the President's spouse, she may perform various external activities in the fields of welfare, education, healthcare, and culture and directly or indirectly support the President's work. The institution of the First Lady of the United States is unique in that she is neither elected nor appointed yet performs public duties. Section 105 of Title 3, United States Code (USC), states, 'Assistance and services authorized pursuant to this section to the President are authorized to be provided to the spouse of the President in connection with assistance provided by such spouse to the President in the discharge of the President's duties and responsibilities. If the President does not have a spouse, such assistance and services may be provided for such purposes to a member of the President's family whom the President designates.' U.S. federal law provides a clear legal basis for supporting the public role of the President's spouse, and all public activities are within the legal framework, which is in contrast to our own. In Korea, the President's spouse is a public figure who receives public support such as security from the Presidential Security Service under the Presidential Security Act. Although the President's spouse is not directly elected by the people, she is still engaged in public activities. As the first advisor and proximate policy maker to the President, the President's spouse plays an important role in the formation of the President's policies and final decision-making. It is difficult to deny that the President's spouse has absolute influence, directly or indirectly, in the process of carrying out the presidency. Today, the activities of the President's spouse are becoming more important, and the scope of their public activities is expanding. Despite this, we do not have an explicit legal basis for defining the scope of their activities or providing them with human and material support. It is in line with the principle of the rule of law to clearly define the duties and roles, responsibilities and obligations, and staff and supportive budget of the First Lady, the spouse of the President. It is also necessary to clarify the legal status of the President's spouse in the law to ensure transparency in state affairs and implement accountability in public administration.
