초록

최근 디지털 기술의 급속한 발전을 배경으로 현실세계의 데이터를 대량으로 수집하고 네트워크상에서 처리하여 인텔리전스로서 현실세계에 피드백하는 움직임이 있다. 특히 빅데이터와 인공지능의 활용이 가속화되고 있는데, 이것이 기업과 개인의 행동양식을 크게 변화시켜 세계 각국에서 비즈니스 모델의 혁신을 만들어내고 있다. 디지털 변혁의 진전의 저류에는 물건으로부터 서비스에의 부가가치의 원천의 변화가 있다. 물건은 단독보다는 서비스와 조합해 판매되게 되어 있고 물건과 서비스가 결합한 시스템(PSS)은 개발도상에 있다.
우리 정부는 디지털 변혁 후의 사회의 발전상으로서 필요한 물건·서비스를 필요한 사람에게, 필요할 때에, 필요한 만큼 제공하는 초스마트 사회를 제창하고 있어 향후 여러가지 서비스가 제휴해 네트워크에서 소프트웨어로서 제공되는 것이 증가한다고 보여진다. 이러한 디지털 변혁이 진행되고, 서비스의 소프트웨어화가 진행되는 세계에서는 스파이럴 모델의 혁신이 필요하다. 거기에서는 기술 기점에서 직선적으로 혁신이 발전하는 것이 아니라 사회적 과제의 해결을 위해서 사회와의 대화를 쌓아 가면서 사회적 가치를 창조하는 것이 요구된다.
디지털 경제는 산업의 계층 구조화와 플랫폼 전략의 확대를 가져온다. 이 결과, 지금까지의 업종별 종적 규제의 틀에서는 과도한 규제가 생겨 혁신이 저해된다거나 혹은 기존의 틀의 틈에서 법적 안정성이 결여되는 등 불편한 상황이 발생할 가능성이 있다.
규제의 기본방향을 생각함에 있어서는 완전 경쟁의 가정, 정보의 비대칭성의 부존재, 외부불경제의 부존재, 의 3요건이 충족되지 않는 경우에 정부의 개입이 정당화될 수 있다. 디지털 변혁으로 새로운 비즈니스 모델이 출현한 경우에는 기존 규제와의 저촉만을 판단할 것이 아니라 이러한 요건의 상황을 정밀하게 조사하여 생각할 필요가 있다. 또 산업의 계층 구조화의 진전에 수반해 종적인 규제로부터 기능별의 규제로 재조합해 가는 것이 요구된다. 게다가 스파이럴 모델의 혁신을 원활히 추진하기 위해서는 일정 범위에서의 실험적인 대처를 허용해 결과를 보면서 규제를 생각해 가는 것이 중요하다. 그것이 사회적 과제의 해결과 관련되는 경우에는 사회와의 대화의 장을 마련하는 것이 필요하다.
규제의 대응은 디지털 변혁의 속도에 영향을 미치기 때문에 신속성이 요구된다. 다른 나라의 상황을 확인하면서 사후에 대응하는 것은 세계적 수준의 혁신은 발생할 수 없다. 가이드라인의 활용 등에 의해서 대응의 신속화를 도모하는 것을 생각할 수 있다. 또 디지털 변혁으로 서비스가 글로벌하게 이용되는 사례가 증가해 갈 것으로 생각되어 그 규제의 본연의 자세를 생각할 때는 국내의 이해 관계자와의 조정에 머무르지 않고, 주요국의 규제 동향을 파악해 규제의 내용을 가능한 한 국제적으로 조화시킬 수 있도록 노력해야 할 것이다.

Against the backdrop of the recent rapid development of digital technology, there is a movement to collect large amounts of data from the real world, process it over a network, and feed it back to the real world as intelligence. In particular, the use of big data and artificial intelligence is accelerating, which is significantly changing the behavior patterns of companies and individuals, creating innovation in business models around the world. Undercurrent of the progress of digital transformation is a change in the source of added value from goods to services. Goods are sold in combination with services rather than individually, and a system combining goods and services (PSS) is under development.
As a way to develop a society after digital transformation, our government is advocating an ultra-smart society that provides necessary goods and services to those who need them, when they are needed, and in the amount needed. In the future, various services will cooperate and be provided as software over the network. appears to be increasing. In a world where digital transformation is progressing and services are becoming software, innovation in the spiral model is necessary. There, innovation does not develop linearly from a technological starting point, but it is required to create social value by building dialogue with society to solve social issues.
The digital economy brings about the expansion of industrial hierarchy and platform strategies. As a result, there is a possibility that inconvenient situations may arise, such as excessive regulation in the vertical regulatory framework for each industry so far, which hinders innovation, or lack of legal stability due to gaps in the existing framework. When considering the basic direction of regulatory policy, government intervention can be justified if the three requirements of the assumption of perfect competition, the absence of information asymmetry, and the absence of external diseconomies are not met.
When a new business model emerges due to digital transformation, it is necessary to carefully examine and consider the circumstances of these requirements, not just judge whether they conflict with existing regulations. In addition, with the advancement of industrial hierarchical structure, there is a need to reorganize from vertical regulation to regulation by function. Moreover, in order to smoothly promote spiral model innovation, it is important to allow experimental measures within a certain range and consider regulations while looking at the results. If it is related to solving social challenges, it is necessary to establish a space for dialogue with society.
Regulatory response requires speed because it affects the speed of digital transformation. World-class innovation cannot occur by checking the situation in other countries and reacting after the fact. It is conceivable to speed up response by utilizing guidelines, etc. In addition, it is expected that the number of cases in which services will be used globally will increase due to digital transformation, so when considering the original stance of the regulation, it is necessary to understand regulatory trends in major countries and not just coordinate with domestic stakeholders. Efforts should be made to harmonize the contents internationally as much as possible.
