의료서비스의 패러다임 전환: 비대면진료의 제도화와 의약품의 처방 및 판매에 관한 고찰 (Paradigm Shift in Healthcare Services: A Study on the Institutionalization of Telemedicine and the Prescription and Distribution of Pharmaceuticals)

초록

진료는 의료기관에서 의사가 환자의 상태를 진단한 후 적절한 치료를 하거나 필요한 의약품을 처방하는 것으로서, 처방전에 기재된 의약품을 약사가 조제하면 환자는 이를 수령하여 복약지도에 따라 복용하는 일련의 과정으로 이어지게 된다. 의사는 환자를 대면하고 의학적 판단을 기초로 환자의 건강 상태에 관하여 정확한 진단을 내리고 의약품을 처방하는 것이 원칙이나, 코로나19와 같은 위기 상황에서는 대면진료가 아닌 다른 방식을 검토할 필요가 있었다. 그러나 긴급한 팬데믹 상황이 해소된 지금 현행법상 의료행위로 인정되지 않는 비대면진료를 전면 시행하고자 하는 이유는 새로운 의료 서비스에 대한 편의성을 국민이 경험하면서 이에 대한 수요가 생겼기 때문이며, 국민의 의료접근성 확대를 목적으로 정부가 추진하고 있는 비대면진료의 제도화를위해서는 의사가 환자를 비대면으로 진료하는 것뿐만 아니라 그에 따른 의약품의 처방과 조제 및판매부터 환자가 이를 수령하고 복용하는 전반적인 과정을 면밀히 논의할 필요가 있다고 판단하였다. 이 글에서는 현행법과 판례를 토대로 비대면진료의 시행에 관한 선결문제를 다루고 정부와관련 기관에서 발표한 정책보고서 및 해외 사례 등을 검토하였으며, 의약품의 처방 및 판매와 관련된 쟁점을 분석하고 제도의 정착을 위해 필요한 조치 및 적절한 개선 방안에 대해 연구하였다.

영어초록

Medical treatment generally involves a sequence of steps: a doctor diagnoses a patient’s condition, provides appropriate treatment or prescribes necessary medication at the hospital. A pharmacist then dispenses the prescribed medicine, and the patient takes the medication, following the given instructions for its proper use. The standard practice in medical care involves a doctor conducting face-to-face consultations, providing accurate diagnoses based on clinical expertise, and prescribing medications customized for the patient’s health condition. However, during crises such as the COVID-19 pandemic, it became necessary to consider alternative, non-face-to-face methods of consultation. Although the pandemic emergency has now subsided, there is increasing interest in implementing non-faceto- face consultations, which are not currently recognized as medical practice under current medical law. This interest arises from the convenience patients experienced during telemedicine, creating a demand for this new type of medical survice. To institutionalize telemedicine, as the government aims to improve accessibility to healthcare, it is essential to thoroughly go over not only for doctors to give some medical treatment patients face-to-face but also the overall steps—from dispensing prescription drugs with carefully explained instructions such as valuable advice on managing side effects of certain medications by pharmacists to purchasing and properly taking prescription medicines. This study explores the fundamental issues related to the implementation of telemedicine, grounded in an analysis of existing laws and judicial precedents. It also examines policy reports from governmental and relevant organizations, along with international case studies, to provide a comprehensive perspective. Additionally, the research investigates critical challenges concerning the prescription and distribution of pharmaceuticals and proposes necessary measures and policy improvements to support successful institutionalization of telemedicine.
