민주법학과 노동법학 방법론 (A Democratic Jurisprudence and A Controversy over Methods of Labor Law)

초록

민주주의법학연구회가 창립된 것은 1989년 1월 5일이었다. 그리고 2009년 10월 17일 아주대학교에서 본 연구회 창립 20주년을 기념하는 심포지엄이 개최되었다. 이 심포지엄은 20년 동안의 민주법학을 되돌아보는 것으로 각 전공영역별로 민주법학에 발표된 논문들을 검토하기로 한 것이다.
필자는 노동법영역을 담당하여 관련논문들에 대하여, 민주주의법학연구회 창립선언문에서 내세운 시사성, 과학성, 민주법학을 통한 민주사회 달성이라고 하는 목적에 비추어 검토하였다.
결론적으로 보면, 노동법관련 논문들은 시사성이나 과학성이라고 하는 목적에 매우 충실하게 대처하여 왔다고 평가하였다. 그러나 민주법학을 통한 민주사회 구축이라고 하는 목적에 있어서는 민주법학에 발표된 논문들이 노동법 학문 분야에서 다수설의 입장에 기여한 바가 크다고 할 수 있으나, 입법이나 사법부의 법이론과는 괴리가 있다는 것을 지적하면서, 그 목적 달성에는 성공하지 못하고 있다고 평가하였다.
그런데 어쩌면 입법이나 사법부의 법이론에 대한 실천상의 괴리 내지 실패는, 연구의 방향이 시사성을 갖고 현실참여를 통한 과학성 달성과 비교할 때에, 처음부터 예정된 것이라고 할 수도 있다는 것을 지적하였다. 동시에 우리는 연구의 시사성이나 과학성에 철저하면서 이러한 괴리를 줄이기 위한 노력을 계속적으로 할 것을 제안하였다.

영어초록

The Democratic Legal Studies Association was established on January 5, 1989. And then the Association held a conference commemorating its 20th anniversary at the Ajou University on October 17, 2009.
What the conference intended to pursue was to retrospect the activities of the Association for the last two decades. I was nominated as a reporter with respect to the part of the articles(about 100 articles) in the area of labor law published in the Journal of Democratic Legal Studies, and I presented my research at the meeting.
This is an article that I amended and complemented paper of the presentation. In this article, I tried to analyze many articles related to the labor law reported at the Journal during the last 20 years or so, in light of actuality and science of the articles, and with respect to the degree of support from the people, the National Assembly, and the courts. Because these points of analyzing the articles were what the Association proclaimed, that is, especially a participation in a real society, pursuing a scientific method in performing researches, and establishing a democratic society through a democratic jurisprudence, in the statement of its establishment declaration in 1989.
Conclusions are as follows:First, those articles had highly performed its roles of actuality. Most of all dealt with real problems occurring in the society in all the times.
Second, those articles had faithfully pursued a scientific method in researching the problems. Especially, all researchers participated in the field on the side of labor. Futhermore, they researched the labor law issues with knowledges gained in workplace.
Third, even though they succeeded in the goals of actuality and science in the establishment declaration, I could not be able to conclude that the members of the Association had reached the last goal, that is, establishing a democratic society through a democratic jurisprudence. Of course I hope that my conclusion on the last goal is only true in my own opinion. In general, however, it can not be denied that there are many estrangements between the members’ legal theories derived from those articles and the statutes or the holdings by the courts. It may be very difficult for the members to perform the last goal simultaneously with another goals of the Association from the beginning. It may not be an easy task to realize the last goal for a long time. But here I suggest that we can not help endeavoring to reach the last goal continually.
