초록

19세기는 조선시대 사법제도의 역사에서 앞 시대와 뚜렷이 대비되는 시대적 특징이 있다. 사형범죄 등 중범죄를 취급하는 형사사법의 영역에서는 19세기는 ‘審理의 시대’라 부를 수 있다. 조선 시대 사형사건의 재판절차의 필수적 부분이었던 삼복제도는 정조 3년(1779) 11월 12일에 거행된 마지막 삼복을 끝으로 이후 갑오개혁에 의한 새로운 재판제도가 시행되는 1895년까지 120년 동안 법전에만 존재하였을 뿐이다. 이제 待時의 사형죄인들은 정기적인 계복을 통해 최종 처리되는 것이 아니라, 부정기적으로 시행되는 ‘審理’의 기회에 재심을 받고 仍推 또는 傅生의 처분을 받았다. 심리의 시대에는 사형판결 없이 사형죄인을 처리하고 징벌하고 있었다. 그러나 이 시대의 모습은 우리 눈에 잘 보이지 않는다. 『日省錄』과 『秋曹決獄錄』에 수록된 방대한 살옥안 처리 기록에서 단편들을 모으고 일일이 이어 붙여야 비로소 그 모습이 드러난다. 이렇게 확보된 일련의 사건기록에 관찰사가 살옥죄인을 조사ㆍ심리하여 올린 審理狀啓과 査啓 등의 장계등록 자료를 합치면, 64명의 살옥죄인에 대한 통합된 사건기록을 확보할 수 있다. 이 글에서는 19세기 살옥안 심리에 관련된 장계등록 자료의 현황을 소개하고, ‘사형판결 없는 사형죄인의 처리와 징벌’이라는 그 시대적 특징을 보여주기 위해 몇 가지 사례를 소개하였다. 64개 사건기록은 심리의 시대 살옥사건 처리의 실제와 경향을 한눈에 파악할 수 있도록 하이라이트처럼 보여주며, 조선 후기의 법제사 및 법과 사회 연구를 위해 유용하고 흥미로운 사례들을 제공한다.

영어초록

The 19th century shows distinct features in the history of the judicial system of the Joseon Dynasty, forming a sharp contrast with the preceding period. In the realm of criminal justice that penalizes felony crimes with sentences such as the death penalty, the 19th century can be called the era of simni(審理), or special reexamination. In the traditional criminal procedure, even after determining the death penalty for criminals who committed crimes punishable by death, it was required to review and deliberate the case three times and confirm the king's will before the execution of the death penalty. This practice was called sambok(三覆), which means three-times-review, or gyebok(啓覆). Meanwhile, in the late Joseon Dynasty, the simni reexamination were frequently conducted as a special reexamination procedure for finding prisoners who had dubious or extenuating circumstances, so as to mitigate the death sentence. In the 19th century, the simni reexamination became the general way of disposing death penalty cases instead of the gyebok which has no longer been practiced after 1800. Therefore, in order to study the criminal justice administration of the 19th century, it is necessary to recognize and understand trends and features of the era of simni, in which criminals charged with murder and manslaughter were treated and punished without death sentence. However, the features of that era are difficult to examine. They can be reconstructed only when fragments are collected and connected one by one from the vast criminal case records in Ilseongnok(日省錄), or Records of Daily Reflections, Chujogyeolokrok(秋曹決獄錄), which are the records of the decisions and dispositions of criminal cases by the Ministry of Justice, and Janggyedeungnok(狀啓謄錄), which consists of copies of governors’ reports to the King. Combining these three records provides a series of case records for 64 prisoners. In this article, we explored aspects of this era using this archive. Highlights of the 64 case records are presented to help the reader grasp the reality and trends of this period at a glance, and provide useful and interesting cases for the study of legal history and law and society in the late Joseon Dynasty.
