영어 초록

Weak responsive capability of private sector is one of the causes that the regulatory reform has not appealed to regulatees. Previous researches mostly emphasize the administrative regulatory reform. This report stresses the company"s capability to cope with technological regulations as a regulatee when the regulation is premised on an interaction between regulators and regulatees. The report also aims to recognize the way to improve interactions between regulators and regulatees well.
Through various research reviews, the report showed that the regulation and innovation have complex interrelationships. The benefits of regulations considerably depend on timing a regulation enacted and regulatee`s characteristics. Recently government tried to reduce regulatory bottlenecks. However, regulatee’s little understanding of regulations and poor responsive capability still limit the full effect of the regulatory reform. To examine the regulatees’ capability, this report examined start-ups in three emerging industries: digital health care, drone and big data by surveys and interviews.
The results identified several drawbacks start-ups facing currently. Start-ups achieve about two mandatory certifications in average for entering market. The lack of regulatory experts also hinder to accumulate regulatory responsive expertise. Overt factors leading the bottlenecks are cost and time, but covert factors such as lack of human resources and limitation of information access also weaken the responsive capability of start-ups. Features of immature industries (e.g. the lack of information, slow and unpredictable administrative process and lack of regulatory guidance) play as external drawbacks to impede growing start-ups’ capability.
Based on the research results, this report provided several policy suggestions. First, an officially authorized ‘regulation support center’ would support start-ups to enhance their responsive capability to technological regulations. Start-ups’ participation is the key to accumulating their long-term capability. Second, it is recommended to provide demand-driven information on technological regulations by a solid system. Third, regulatory guidelines and manuals should be issued to relieve uncertainty. It leads to public discourse and evolves into better regulations. Fourth, it suggested designing an incentive system to motivate regulatees to comply with those manuals. Fifth, regulators’ expertise should be promoted. Expanding mutual recognition is also recommended for fast process. Sixth, a priority approval system can be introduced to reduce process delays. Seventh, fostering intermediate organizations with authority is recommended. Those organizations gather collective voices from not only start-ups but all stakeholders in the industry so that they could empower firms’ responsive capability. Last, certification and testing institutes should design a supporting mechanism and create databases to keep the supporting know-how linking with official manuals.
