한국어 초록

"자본시장과 금융투자업에 관한 법률"은 기존의 한국 자본금융관련법률이 가지는 대내적, 대외적 한계를 극복하여, 당시의 국제경제의 흐름에 대응하기 위하여 제정되었다.
즉, 당시 한국내의 금융체계가 간접금융상품에 편중되어 있고, 이로 인하여 기업들이 국내자본시장을 통하여 원활한 자본조달에 한계를 가졌고, 통일화 되지 못한 법체계로 인하여 금융업계 역시 그 운영과 성장에 많은 제약을 가지고 있었다. 또한 투자자들에 대한 보호 역시 부족하여 자본금융시장에 대한 위험인식이 높은 상황에서, 전세계의 개방화 추세를 따르기에 역부족이었다.
이에 포괄주의 규율체제로 전환, 기능별 규율체제로의 전환, 금융업무범위의 확대, 투자자 보호제도 선진화를 골간으로 기존의 관련법률들을 정리하고 통합하여 현재의 "자본시장과 금융투자업에 관한 법률"을 제정하였다.

영어 초록

In order to overcome the internal·external limitations and respond to new international economic flow, the Financial Investment Service and Capital Market Act had legislated in South Korea.
In that time, South korea's financial system unusually focused too much on indirect financing instrument and applicable law system had not existed. Thus many companies had a lot of limitations o fobtaining capital in Capital Market. At the same time there were a lot of restriction on the operation and buginess growth in financial industry sector and investor protection was also in short supply. In the situation of high risk perception for the capital's financial market, South korea' finacial system was unable to follow the trend of financial liberalization.
The conversion into comprehensive definition rule system, the conversion into functional discipline system, the expansion of the financial task scope, the enhancement of investor protection system, these as a focal point, south korea had put the existing rule in order and unifided, finally legislate the Financial Investment Service and Capital Market Act.
