제1장 서 론
제1절 문제제기 및 연구목적
1991년경부터, 크로아티아에서 소수파인 세르비아계가 유고슬라비아의 지원을 받으며 전쟁을 벌이고 있었다. 세르비아계는 비록 수는 적었지만, 우월한 화력과 훈련으로 무장하였고 그래서 수적으로 우세한 크로아티아 軍은 세르비아계 무장 세력을 제압하지 못하고 있었다. 4년 동안 계속되던 크로아티아의 전쟁은 1995년이 되자 휴전상태에 이르렀다. 그런데 이 모든 상황은 미국 민간회사 MPRI(Military Professional Resources Incorporated)가 개입하면서 180도 바뀌었다. 1995년 봄, 현대적인 서구식 군대로 바뀐 크로아티아 軍이 기습적인 ‘폭풍 작전’ 공격을 감행했고, 집중적인 기동작전으로 세르비아계를 물리쳤다. MPRI는 ‘NATO 육군대학에서 A+ 학점을 받았을’만한 이 작전을 세우면서 어중이떠중이였던 크로아티아 軍을 뛰어난 현대식 군대로 훈련시켰고, 패배는 승리로 바뀌었다.

제1절 PMF와 현행법 사이의 문제점
민간군사기업이라는 전쟁의 새로운 행위자를 법적으로 접근함에 있어 근본적으로 문제가 되는 것은 이 새로운 행위자를 둘러싼 법이나 규제 등이 명확하지 않다는 것이다. 민간군사기업은 군사용역을 판매하는 사적 존재이다. 국제법상 이처럼 스스로 군사용역을 판매하는 개인 ― 용병으로 더욱더 잘 알려진 ― 은 일반적으로 금지되어 있다. 하지만, 국제법에서 용병의 정의는 일련의 다소 제한적이고 모호한 조건을 갖추어야만 한다. 즉, 그 모든 조건을 만족시킬 수 있는 대상을 찾는 것은 거의 불가능하다고 할 수 있다. 게다가, 본래 反용병법은 군사용역의 거래를 금지하기 위해서가 아니라 단지 그것을 규제하기 위해서 창안되었다. 그러므로, 현재의 민간군사기업과 같은 새로운 행위자를 정의할 수 있는 법적 토대는 전무한 것이나 다름없는 것이다.
