I. Introduction
Although an intangible right, the right to privacy is a right with great meaning as a part of the constitutional right to personhood. Therefore, it requires specific institutional devices capable of forming such right and specifying the legal interest to be protected for protection of the human rights of the members of the society. In this essay, I will compare the invasion of privacy and the remedies and exemptions relating to it between Korea and the United States, and then explain the future prospect of Korea’s right of privacy.

In the United States, disclosure of private facts do not constitute privacy violation when such disclosure has a legitimate public interest, based on the freedom of press and publication stipulated in the 1st Amendment. Legitimate public interest refers to the matters that the reasonable lay people may be normally interested in, and whether a certain matter is of legitimate public interest will be determined based on the general norm or custom of the people’s community. However, which part of an individual’s private life falls under a legitimate public interest has to be decided on a case-by-case basis. The bottom line is, disclosure of private facts just for the sake of arousing interests of a group of unreasonable people is a privacy violation.
